i am cheated . need my money/mobile back

I have purchased G-Fone G-588 Dual SIM GSM+GSM /
GSM+CDMA QWERTY , item no :170503805104 from ebay seller "
gadgetsterminal" . my PaisaPay ID 26903709588. i have received this
mobile on 1st July . This mobile was in faulty state . i left the -ve
resopose on ebay & next day , seller contacted me & requested me to
return the mobile to her Sister house in Sec 7 Gurgaon . i have done
same on 6th July , Seller promised me to return the new or repair the
fault in one week & i was Ok for same . i contacted this seller many
times . he is not responding & now he don't pick up the calls . I feel i
am cheated by ebay & will never purchase any other item & nor recommend
others to purchase . This seler is fraud & making money using ebay
I request you to pls help to get my mobile or my money back & pls ban
this seller from ebay so any other use will not be cheated & un
necessary have the -ve impression for ebay

can i log a FIR against this seller ?

Lodge FIR baad mein, first file a case with "ebay guarantee program" and also file a case under "Item not as described" soon.

Get an FIR registered against EBAY and the SELLER as well. EBAY seems to be NON-EXISTING in resolving customer disputes and seems to be sleeping forever when registering cases. They close those cases automatically after 90 days and flush them with the item numbers from their system and JUST FORGETS THEM!
