Pirated software on eBay

I have seen atleast one seller's feedback clearly mentioning pirated software. ( some negatives and some neutrals ) Why is such people again allowed to list on eBay? I have a dispute with one such seller who showed a genuine item ( Game in its original packing ) but sold 2 written CDs. The thing I won in an auction at 0.01 Re+ ofcourse postage of 295 rupees. A genuine game at about 300 rupees is nothing uncommon. So item was obviously mis represented. Some people might consider it cheating.
I sent a pic of what I received to eBay customer care. And eBay customer care say they don't police their site . They dont handle the merchandise. they say they take action on feedbacks. But nothing seem to happen.
And I think there is some rule which doesn't qualify a buyer for their( eBays) protection policy if the cost of the item is less than 50 rupees.
taking eBay or the seller directly to court may be time consuming. But I think I can go to consumer court and make the original game makers to answer. Afterall , I have a receipt for payment for the item.I have emails written to me from seller assuring genuineness of the game. I only want my 295 rupees back. The rest of the matter can be settled by the game developer and eBay/seller if they want to at their own leisure. right??
And if the game was shown ( pictured ) as plain CDs in unmarked case nobody might have bought it , right??

Well I hope you left a negative feedback for the seller then.
And I do hope that you do take up the matte with the consumer or court, or if you really want to then the cyber crime dept. Bangalore, Bombay and Delhi have ones for sure. And I remember seeing a thread at this board giving the contact details of the depts.
I also hope that ebay makes this vital information (contact details of the cyber crimes dept) visible on their website. Maybe a locked thread stuck at the top of the boards.

thank you for the reply. I gave the seller negative feedback. he has other negatives as well. and some neutral saying pirated ( written ) game. and positives asking for KEY. does original games require any further keys??

I dont know about keys, but if you had to copy cracks or mount any images, then its pirated definately.
But he has no right to sell you a home written copy (assuming he doesnt mention this in the listing). I think even then its illegal to make copies of the software and games in the strictest word of the law.

2 amkette CDs identified as AOE1 & AOE2 in my case. (Age Of Empires )definitely written CDs. item cost 1 paisa + postage 295 rupees. And if eBay is getting commision from sale of such items knowingly I think eBay will have to answer. Feedbacks stating pirated software and what does eBay say??
'so sorry... but you see , we dont police our site.. we dont handle items..its only a meeting place for buyers and sellers..'etc.
I think other parties should also be involved in this matter. like asking microsoft to refund?? if its pirated ,let them take up the matter with eBay and the seller!!

I understand your frustration when one faces such a situation.

First of all to clarify, eBay is strictly against pirated items since they violate rights of a copyright owner. Every copyright owner has access to VERO program, where they can complaint against violating listings and eBay takes immediate action against such listings.

Everyday, millions of items are traded on eBay and thousands of people use eBay for their trading activity. It is virtually impossible for eBay to police the site actively in such a condition. Besides, the good thing is that most of the time we do not need such active policing for most people are good and like to be honest and fair in their dealings.

To catch hold of those who are not so good, eBay has a great system called feedback ratings. By reading a user's previous feedback, you can get to know a users reputation, even without having interacted with him once. We encourage all users to check feedback before transacting. As a buyer, you also can use the feature of 'Ask Seller a Question' to clarify any doubts that you might have about a product before buying. You can also use 'Contact eBay Member' feature to ask the buyers feedback about a certain product he bought.

As buyers, I think we need to discourage sellers, who list with 1 Re and high shipping charge, by not buying from them. At least this is a policy I personally follow, I never buy from a seller who has listings in 1 Re with abnormal shipping charge. It gives me a feeling that the seller is not transparent in his dealing.

Internet is a great medium to trade for it is fast, convenient, and gives you access to a vast range of products that you might not get normally. However, while transacting, we also need to practice judgement that we would normally practice while buying from an offline shop.

While eBay enforces policies as and when violations are found, active help from community members also helps in keeping the site healthy.

how about a seller who even after shipping the above written CDs to me , still insisting it is original??
I sent pics of the CDs and the packet in which it was received to eBay cust.care. they dont know a written CD when they see one??
your so called copyright programmes are all very great . But nobody is likely to getaway playing ostrich.
I think pirating /selling pirated software is an offence.
if somebody is knowingly gaining from such transactions then they are also likely to be termed offenders.
eBay better discourage such practises on their site.
As for me I am not likely to buy anything from eBay again.
and feed back ratings???
In my sellers case , he has neg feedback saying pirated software.He has neutral feedback saying written CDs. and positive feedbacks implying copied software? like people asking for keys??

this seller kunal007 who is selling all pirated stuff online, all pirated games priced at more than half their real cost, i originally thought that maybe this is an auction so maybe the seller is selling the original game with lower auction start price, but after winning the auction i asked the seller a few questioned and got suspicious that he is shady adn it might be pirated, but instead ebay sends me a mail saying i must make the payment soon or else i will get banned, so i paid despite my fear of it being pirated, and when the cd did come i was right, it was pirated, now teh seller is so stupid he has given teh address of his actual shop too from where he sells pirated game cds in jalandhar and has openly challenged me to call the police (maybe he bribes the jalandhar police too, and thats how they allow him to carry on the piracy) and ebay is taking its time to even respond to my complaints adn emails and all this is very frustrating, i wonder how the hell will this issue get resolved, will i ever get an original game cd sent or my money refunded? ebay needs to do something sbout this atleast the seller kunal007 http://myworld.ebay.in/kunnal007

Hello ! Please check the fantastic software offered by one demonoid.666 in the Operating Systems section of Computer Software section. The software he is offering seems to be pirated ! The offer seems to be too good to be true !
