Pirated software on eBay

I have seen atleast one seller's feedback clearly mentioning pirated software. ( some negatives and some neutrals ) Why is such people again allowed to list on eBay? I have a dispute with one such seller who showed a genuine item ( Game in its original packing ) but sold 2 written CDs. The thing I won in an auction at 0.01 Re+ ofcourse postage of 295 rupees. A genuine game at about 300 rupees is nothing uncommon. So item was obviously mis represented. Some people might consider it cheating.
I sent a pic of what I received to eBay customer care. And eBay customer care say they don't police their site . They dont handle the merchandise. they say they take action on feedbacks. But nothing seem to happen.
And I think there is some rule which doesn't qualify a buyer for their( eBays) protection policy if the cost of the item is less than 50 rupees.
taking eBay or the seller directly to court may be time consuming. But I think I can go to consumer court and make the original game makers to answer. Afterall , I have a receipt for payment for the item.I have emails written to me from seller assuring genuineness of the game. I only want my 295 rupees back. The rest of the matter can be settled by the game developer and eBay/seller if they want to at their own leisure. right??
And if the game was shown ( pictured ) as plain CDs in unmarked case nobody might have bought it , right??

I have PS2 which came with modchip softwares which are really pirated one's.I had purchased it a year ago.How would one deny the pirated softwares when I knew that the PS2 was a modded one.The game piracy has played a major role in the sale of PS2 aswell as pc games.Prices of the games being increased with the budget 08,you think people would buy the genuine games when they are getting it so cheaply.Don't you think it is a year of piracy

I bought a game,he said he had,then after 2days he said he doesn't have and he has to download it etc,( Now there you go! download pirated )
Lastly,he didnt gave me,nor he replied of dispute anything!
Then I called him up,he was a kid,he started begging from me,that " sir please take another game,i have this n that" lol...
I was like,wish i could record his voice!n make you all laugh!
