CONSUMER'S RIGHT ON E BAY

An aware CONSUMER is an empowered consumer. All consumers should be aware that a venture like e Bay is 100% dependent on consumers and hence the consumer should not be taken lightly. Most of the revenue for e bay comes from two sources : one is the commission from the sellers and the other is the rotating capital of the consumer held with e bay. How will the commission come if there are no consumers or buyers. Kindly understand that aspect.

I had made an attempt to bring in some awareness about the ill health of e bay by drawing attention of the e bay team in my thread on THE TRUE FACE OF E BAY. As you can see there has been no response so far. One irresponsible member has said that those not happy with e bay should leave. Ignorance is bliss but one shouldn't be naive enough to make such remarks which can cause embarrasment. All members enjoy equal rights and the fact that buyers are not united should not be exploited. You may get a surprise.
First a piece of advise. I have not come to go but with a purpose and its a noble one. second if some one has a mischievous mind it shall be exposed and I am for the consumer.
I shall explain what constitutes a complaint, who can file a complaint and how one can file a complaint etc.
I woul dlike to address the problems of the members without any authority being bestowed upon me except what the constitution of the country has bestowed on me,Because I am agitated by the apathy of the system.

Hi deena0808, First of all you must understand that most of the members visiting the Community are Sellers. Buyers don't have much time to be a regular on Community. Secondly, Sellers who are earning their Bread & Butter would not like to go against ebay. But that does not mean that it should stop someone for the problems faced by him or her. If you think you are quite capable of helping out the Community then just don't worry about these kind of lewd remarks. Carry on with your good work.

WHO CAN FILE A COMPLAINT
A consumer
Any volunteer Consumer Association registered under Companies Act 1956
One or more consumers having common interest
In case of death of consumer, legal heir

What constitutes a complaint?
If you suffer loss or damage due to any unfair/ restrictive trade practices adopted by the seller
Purchased goods suffer from any defect.
Service availed suffers from deficiencies
Charged a price in excess of price displayed.
If goods purchased are hazardous to life and safety.

How to file a complaint?
A complaint can be filed on a plain piece of paper. Details of complaint and opposite party.
Documents in support of complaint
Relief what one is seeking
To be signed by the complainant.
Not compulsory to to engage a lawyer.
Layer is a force multiplier. Can invoke RTI and PIL .
Nominal fees to be paid.
Compensation upto 20 Lakhs Dist Forum
20 lakhs to 1 Crore - state commission.
> 1 crore - National commission.

You want your rights and compensation including cost of lawyer, mov around a little.

What do you want from e Bay? Quality goods, quality service and reasonable price. Can this be provided by local sellers? How much of jewelery is hall marked? Can e Bay give an assurance that what is being provided is what is being offered? What measures are required to be taken? How do they police? Is there any random check to screen? Is there any e bay sponsored shop where quality is assured?

These are issues which e bay team should address?! For their own good. What is the culpability of e bay regarding a defaulter dealer?

See I don't think any seller or buyer on ebay has anything personal against anybody on ebay, believe me, the main problem is that we sellers have been on ebay for pretty a long time and we have seen many many such buyers who make such claims but nothing is done.

Lets face the fact, who has the time and deep pockets to go through the legal process in India and stay focused right till the end to bring the issue to its logical conclusion as you want it to be.

We all are aware that ebay is a giant company and probably in the first 5 list in the world and my personal belief is that ebay India does not have much of a say in front of ebay US board members. Very much on the same lines as US of A treats India as a country.

Consumer rights protection looks good only on paper, In a country like ours where our own govt. is the first to infringe upon and take deny its own citizens of it basic civil rights, do you seriously think something can be really done in such a country. I doubt it, exceptions do not make a rule.

Hi,
1)I only marginally earn from indian buyers.But again I pay heavily for indian UPIs.I dont mind if indian buyers dont buy my items.
2)Ebay provides fair platform to address issues.I mean both buyer and seller.
What is your issue really?

I attended a conference on consumer protection in Mar this year.Consumerism is a process through which the consumer seeks redress, restitution and remedy for their dissatisfaction and frustration with the help of their all organized or unorganized efforts and activities. What we lack in our country is education, information resources,testing facilities, competent leadership, price control mechanism and adequate quasi judicial machinery.

World celebrates 15 Mar as the Consumer Rights Day while in our country 24 Dec is celebrated as the National Consumers Day. Why not consider this as an opportunity to give some impetus to consumer satisfaction in this country and also gain some popularity and mileage?
Is someone in e bay hearing? Why don't you take stock of all those Diwali Gifts not dispatched so far and dispatch some more?

I m sure it will make a difference. E Bay please give it a try.
