the seller had agreed to give me a refund. now i got a mail from e bay saying that the seller is suspended. who is responsible for giving me a refund now? help!

Please please please stop selling these chinese so called, multi feature mp3 mp4 players. they are nothing but a headache. they fool people with wrong memory and capacity information for example, it may show 1 GB but will be a few hundred mB actually...
