eBay Purchase Protection Claims

I bought Item #5864120245 from nameit_wehaveit. It was advertised as 256mb mp3 player but I recived a 128 mb player.

nameit_wehaveit tricked me in removing the negitive feedback saying that he would refund the money.

After removing the feedback he states that he doesnot want to refund the money nor has any stock to replace the 128 mb player.

I Filed for an protection claim and received the following update.

QUOTE
2) Appraisal of the Received Item
(Note: An appraisal is not required if the merchandise has already been returned to the seller or if no merchandise was ever received)

The Appraisal must be based on an independent authenticator's physical inspection. Please take the item and a copy of the item listing to a store or neutral third party that specializes in the product and have them determine the value and condition of the item. Have them write their response on store letterhead. We will also need the name and phone number of the person who does the evaluation for verification purposes.
UNQUOTE

I am not aware of any independent bodies that ebay requests for "Appraisal of the Received Item". So how do I find such co-operative independent vendors who are ready do such such???

If anyone can recommend any such vendors in Banglore I would really appreciate.. If none is there another way?

Thanks,
RVi

You may write to Customer Care and mention your inability of finding an Appraisal.
They would be in a position to guide you further.

You may submit the email of the Seller as a proof if he has committed, anywhere in his mail, that a 128 mb player was sent instead of 256mb mp3 player. .
