GST Implication on International selling from India

Hi!!

 

As we are getting messages from ebay India that we need to register ourselves under GST as the same will be applicable from 1st July,I would like to know whether GST Registration is mandatory for selling on www.ebay.com from India?

 

Can someone please help me on this?

Please read the GST rules carefully before calling anybody Absolutely Incorrect.

It is not only for international import but also for export.

 

New Export Procedure:  Till now exports and samples were exempt from any payment of taxes at the time of export. In the new GST regime, exporters need to pay IGST or remove the shipment after submitting a Letter of Undertaking for the value of IGST with GST Officer. The paid IGST or LUT can then be reversed after submitting proof of export (Shipping Bill).

Interesting discussion but I did not find it informative. Infact till yet nothing is clear about a sell created in India from cross boarder buyer on eBay market place as far as Gstin is concerns.
As defined , for entitlement of export catageory , we must have Bill of landing to support it , Indian post receipt or courrior airways bill are not acceptable document under this situation.
It is an overseas sales but law doesnot accept it under new reform bill.
As seller , eBay operating system doesnot allow us to collect local taxes from buyer nor
any option to categorise product under HSN code. Individual seller is helpless and uninformative since the issue is more technical to obey Gstin Law and here government need to work with market place to better understanding rather than we individually.
This reform bill is launched without being practical but now the auhority is working to make this law acceptable by public in large.Hope there would be something for us.

Even though I sent ebay my GST number in Septrember 2017 only, they have not restored my seller account. Are other sellers facing the same problem?
It appears that seller will have to bear the GST even for exported items, although HST is supposed to be exempted for export. Is it true that postal receipt and eBay records are not sufficient to claim refund of GST? It will not be worth my time to run after customs registration, certificate etc. can anyone throw light on the procedure? Does this mean that the small, occasional selling is now closed to us, has the GST refime killed off the "long tail" of niche, hobby product sales by individuals?

GST must be paid or LUT should be applied.

Respected Sir/Madam,

 

We are exporting goods directly to the buyers out side of India using online platform of ecommerce e-bay.com. As per the provision we are force to charge IGST 18% in bill but not claiming from buyer. As in export the GST is not chargeable so we have to take re-imbursement of the IGST. It is reflected in our GST return in form 3A and 1.

 

We have applied for the refund at GST portal. On approaching Sales tax authorities SGST department and CGST department which is now under GST are aware of the system of refund. They are showing there helplessness. They are asking for Shipping Bill No. of cargo mode. Where as we are exporting under courier mode as it is cheap mode means of freight. They are unable to refund us the IGST amount. As per customs, exporting under courier mode is also exports.

 

Kindly let us know

  1. who are the authority to reimburse of the IGST which are being exported under Courier Mode.
  2. Procedure of getting the refund of IGST which are being exported under Courier Mode.
  3. Whether the goods exported out of India through couriers DHL, FEDEX or any other courier will be treated as export outside of India or not and
  4. Whether we will get the refund of IGST on goods exported out of India through couriers DHL, FEDEX or any other courier.

 

Our application is pending for hearing under GST portal.

 

Please let us know the same as early as possible.

    Yes. They cannot be considered as Local Sales because the payment is received from outside of India and the goods are shipped out of India. 

  4. Whether we will get the refund of IGST on goods exported out of India through couriers DHL, FEDEX or any other courier.
    There is no clarity on this matter anywhere in the country. You may do an RTI and ask these questions to CBEC. There is absolutely no clarity on this with anyone in our country.
