Hello,
Can anyone please tell me if PAYPAL IS LEGAL?

I mean when we do export from Post Office they ask for FIRC/PP FORM.

But while getting payment via PAYPAL we do not get any such certificate.

I want to start international Selling and want to ship items through EMS.

Can please kindly tell me how to do export and how to clear the problem of proof of receiving payment( i.e. FIRC/PP Form).

Your help is highly appreciated and I hope I will get details guidelines.

I have IEC Code already.

Dear Deep Agarwal,

The point is that we receive payments in rupees through PAISAPAY .... which also includes foreign currency payments (where the Sellers has made International sales.)

It is an obligation on part of PAISAPAY to issue FIRC as the foreign currency has been collected on our behalf.
We must get a break up of INR and Foreign currency along with a FIRC.

I don't know how other sellers are accounting for International Sales by receiving payments through PaisaPay.

Deep Agarwal, regarding PP Form, I would like to mention that it can be obtained from RBI. It is compulsory to attach PP form when you ship through India Post.

Do keep this thread Live ..... I hope someone from ebay Team would be courteous enough to reply over here.

Would request Sellers who are already Selling Internationally, to put forward their views.

Please kindly clear our doubts regarding the issue raised.

This will really help in exporting items in accordance to the Laws.

I hope that Paisapay will surely provide detail information on this issue.
Other sellers are also requested to provide any information which can be helpful.

Community boards are meant for helping each other and getting information,So eBay can you please give detail information in interest of all eBay sellers.

Don't worry .... just keep this thread alive.

Let's be patient and see why someone from ebay gives us a proper reply.

Last time they replied ..... that everything is as per the law.

This reply is not acceptable.

What we want to know is whether receiving International payment in rupees through PaisaPay (without FIRC) and shipping the goods outside the Country .... is legal or not.

To the question of whether using PaisaPay for your international sales is legal - please allow me to assure you that "PaisaPay service is in full compliance with the foreign exchange laws in the country".

For your other specific questions, I will advice you to consult a expert in the field. Tax / laws are complex in nature and it is not prudent to discuss it on boards. Any tax / law related question can have various answers depending on various factors. It will not be fair to advice our user regarding a business practice basis the limited information on the boards.

I will again urge you to consult an expert or consultant, for eBay is not equipped to give legal advice to sellers.

Please kindly note that I am not asking any legal advice from ebay.in atleast ok ?
I know one thing that eBay can not post annoucement correctly rest aside any legal advice.;)

I am asking about the FIRC as when we do export to other countries its the essential document.The custom officers asked for that and without it export is not possible.

So please kindly do not try to make the things round and round and escaping the main point.

Please reply me in connection to the FIRC, when a seller receive foreign payment via paisapay.

Hello Sapana,

We know that ebay doesn't do anything against the law of the Country in which it functions.

You have said that Any tax / law related question can have various answers depending on various factors.

Do you want to say that you are hardly concerned and Sellers have to devise ways on how to cheat a GOVERNMENT?

Law / Tax related questions can never have various answers .... but always have SPECIFIC answers.

Income Tax Slabs are specific.
Sales Tax rules are specific.
Marriage Laws are specific.
Company Laws are specific.

We are not seeking any advise from you on any tax related issues. We are simply asking for a certificate against foreign currency received by you on Seller's behalf, for International Sales.

That's quite SIMPLE.

In case you cannot provide the same then do let us know what to do ? What is the other alternative ? What should we reply to the RBI ?

That's because it's the requirement from the RESERVE BANK OF INDIA.

It's a serious issue which you cannot bypass.

If ebay doesn't have the answer for this then why don't you organise a Workshop on this by inviting an EXPERT who can clear our doubts.

In case you don't solve this issue ..... it would make my belief more firm that .... something is FISHY out there ?

Hello,

Q. What does RBI says on advance payments ?

A. The shipments made against the advance payments are monitored by the authorised dealer through whom the advance payment is received. The appropriations made against every shipment must be endorsed on the original copy of the inward remittance certificate issued for advance remittance. .

Hello Deepji and indconcepts,
I am sorry for not writing earlier.
Every time an international buyer clicks 'buy', gets a message somewhat like 'please confirm with the seller if this seller is willing to ship to your country'.
This message is enough damaging. Well this is my opinion. I sport in the shop header 'SHIP TO ALL COUNTRIES'. But buyers are still getting that. I thought somethings wrong in the preferences. But things are just okay there.
Had I been a buyer and got this message in indian site, I will simply go to china ebay and spend my buck over there. I have a feeling that I lost a lot of buyers that way.
About legal aspects, I can say from experience that, laws are made in such a way so that it may mean both ways: :guilty or not guilty. This is the single reason people avoid talking.
I dont advice bypassing law, but one can of course, use prudence to take advantage of the minute gaps, just enough to pass through.

Thanks for writing on this topic.

The main point of discussion over here is whether it's legal for a Seller to accept payments from abroad through PAIAPAY ?(without any inward remittance certificate being issued by PAISAPAY)

Do let us know if you are aware about the legalities.

We are not receiving any specific reply from ebay on this issue.
