Hello,
Can anyone please tell me if PAYPAL IS LEGAL?

I mean when we do export from Post Office they ask for FIRC/PP FORM.

But while getting payment via PAYPAL we do not get any such certificate.

I want to start international Selling and want to ship items through EMS.

Can please kindly tell me how to do export and how to clear the problem of proof of receiving payment( i.e. FIRC/PP Form).

Your help is highly appreciated and I hope I will get details guidelines.

I have IEC Code already.

Thanks in advance for your help.

Its about getting FIRC from Paisapay for foreign payment,as it is essential for exports.

Hello Devesh,

Yes, Only the Authorised agents (which is normally a bank) can issue FIRC.
PaisPay can always arrange FIRC through the Authorised agent from whom the foreign currency has been routed.

Other Payment Processors like the one CC Avenue (which claims to be the South Asia's Biggest Payment Processor) also issue FIRC.

I don't know what's the hitch PP has .... that they don't even want to debate on this issue. .

Hello Friends,
I have some latest updates on the issue.

I had to send some item to a buyer of Italy and thus I had went to the custom office.Today I had visited the main custom office here in Surat and met the Custom Officer incharge.

I had explained him about the things how we eBay sellers sell through www.ebay.in.

He said that whenever anyone do any export in which the payment is sent in advance, there must be a FIRC.
He said that its completely illegal to send any thing outside India without having the FIRC.

I told him that all the eBay sellers are dealing like that only,We eBay sellers do not get any FIRC from the payment gateway(Paisapay).

He said its a very wrong practice if any seller are doing such things and it may cause worst result for person sending item like that.

I will have to refund 100% amount to the buyer of Italy and I also afraid if he takes the things in suspicious way and post a negatuve feedback for me.

So friends all the eBay sellers doing export by accepting money via Paisapay are always in risk.

Its illegal to send items without FIRC.

I am posting all the information in interest of my seller friends and now no long story will help anyway.

Any person who have genuine knowledge about the issue is requested to post their views on this.

All eBay sellers doing export by accepting payment via paisapay are in danger(No FIRC = Illegal)

We sellers will never get a Direct reply from eBay regarding the issue(FIRC for International payment received through Paisapay).
eBay do not want to post anything which is related to FIRC because there is something fishy going on.

I hope more seller will realise that there are strick rules and laws regarding the export of items.
I want my seller friends to be 100% safe and do all the exports in a 100% legal way.

Sorry for not being able to visit the community regularly now-a-days. Last time also I saw a similar thread and its here this time too. So I think this is our hot topic now !! Why not !! Everybody feels good to earn some FOREX for the country.

I am not knowledgeable about this but here's my opinion.

Now about the FIRC - When we export something ( outside ebay ) we get the payments in our Bank accounts. Then we get FIRCs from the bank as the amounts have been remitted directly to our accounts ( thru various Bank instruments like Swift transfers / online transfers .... ). But here I think PaisaPay is getting the FOREX remittance in their account and they are entitled to get the FIRC from the Bank. We are getting payments in INR from PaisaPay after deduction of their charges etc. So its not like a simple export that we do in our professional fields. There we are entitled to get benefits of FOREX earning ( dwindling day by day ) but I doubt whether our exports thru ebay will entitle us for any such benefit as its not direct but via ebay. So one has to talk with a knowledgeable legal expert to know whether we are entitled to get FIRC. I don't like talking to the Govt. personnel. With due respect to the members talking to various Govt. officials, my personal experience about the legal knowledge of many high ranking Govt. officials, is not a bright one. In my professional life ( quite small compared to many of our fellow members ) I have seen many Govt. officials with high ranks but a very shoddy knowledge. Many are more concerned to earn some extra bucks than updating themselves with the ever changing rules and circulars. I have seen many officials who were trying to slap penalties on me on some flimsy grounds. I had to show them the rules in their own books ( they don't rely on the information displayed on their own sites ) to prove that they are wrong. So better to consult with some knowledgeable legal practitioner dealing with EXIM cases. If we are entitled to get FIRCs then ebay must send those.

In the RBI PP form (link above) only the money received has to be stated. It does not ask specifically for FIRC.

Dear Deep, I saw in one post that you are thinking about refusing an order from Italy as you do not have FIRC and do not want to declare the item as gift. Gifts worth upto 1 lakh are now exempted from such formalities ( link above ). Anyway its good to be honest but not good to loose business. So I have one suggestion, mainly for high value transactions. I had once paid you thru one ICICI account. Hope you are still continuing that. In that case you may request the buyer to make a Swift transfer directly to your account. The total charges ( sender + receiver ) for such a transfer from Italy should normally be around 10-15 Euros + Rs.281. The charges varies with the Banks and amount but for high values it won't be too much higher than the PaisaPay charges. It can even be less for very high values like, say, 50K. As you know, thru Swift transfer you can get the money in 3-4 days and get the FIRC readily from the Bank.

Lastly, if we are entitled to get FIRC then ebay must issue it. Else they should at least participate in the discussions and explain rather than locking the postings.
Sapana, I am sorry if I sound rude but please ask someone from your side, knowledgeable about those, to participate and pacify the members. I think Umang too sounds distressed. Its disastrous. Don't let the discontent grow. I don't know which thread has been locked, as referred by Deep. But locking threads will just aggravate the matter. .

eBay is not giving any direct reply to the issue but I will not give up until I get a solution for the issue.I will keep the post alive till we get all answers to our questions.

I am also little upset that other members are not taking any interest in this issue,May be they afraid that it will cause some problems to them,But I think that if we are not wrong then we must not have any fear whatsoever.
