Legal Option Against Ebay and Seller insihozi

I have purchased 16gb Pen camera to give gift to my friend on birthday. Seller, insihozi sent me 4 GB pen camera.

I have given Negative feedback and for the 12gb difference he have refunded me 100 INR

Now he is askign ebay court to remove negative feedback.

I want to drag Ebay and seller to a Legal court. Its not a matter of 1500 INR its a matter of cheating.

I dont have to worry about lawyer fees as I am going to apply using consumer Court.

Can anyone advice me using it.

How can I create lots of trouble for cheater seller? Is there any responsibility of ebay too?

i would advise that you give a pic of the item and all the written communication that you have had with the seller in your reply to seller's eBay court statement. the buyer uday parekh is new on ebay and 16gb camera pen was sent to him. on receiving it he said its 4gb, i asked him to send it back cos i always feel customer is right. but he said he does not want to send it back, option of refund was given and he agreed to it, i also have a mail from him saying thts great refund 100 and he gave me his account no. after the amount was deposited he gave me a negative reply. all i want to say is if he had sent the item back his lie would have come true to me cos the pen sent was 16gb only all he wanted money so he dint sent the item back.

Yes I have to take refund as I have a right to get my money back. And if you think difference between 4gb and 16gb is 100 INR then give me 12gb for 100 INR.

Will you give me? If your product is 16gb then why should I talk about legal options.

If you know anyone in surat you can send him to me and just ask him to see your GREAT (????!!!!) product

I agree with you. Sometimes it happens that some of buyer gets same product as described but they like to say negative everytime. Maybe something happened with you. If you really done anything wrong please kindly look into it.

Did you care to communicate with the seller before leaving a negative feedback?

If you contacted them and they still didn't co-operate then you have all the rights to go to court.

If you didn't communicate and punished the seller directly as most of the new buyers like you would do due to lack of knowledge, understanding and patience, then you shouldn't raise issues now.

udayparekh2009,If you had paid via Paisapay then you will get refund fully by raising a dispute in Resolution centre of Ebay online as item not received as described and escalating to claim for full refund.
