Workshop- 'Receiving International payments' by niceshop4u (15 June 5-6 PM)

Dear niceshop4u,
Please note that we all sellers (old and new) need to go in accordance to the India's Law about exports.

FEMA regulations are very strict and any violation of the law will not result into financial loss but also into imprisonment.

So it’s better that NO sellers should practice illegal ways to send items as a Sample/Gift.The outcome may be very dangerous.

A seller's Ignorance can not be considered as excuse for any such violation of laws.

When we sell anything to international buyers then it is considered as Export (Commercial value).
And as per the RBI Guidelines all payment from export must be receive through Authorized Dealer in India.
Generally Bank is an Authorized Dealer and it issues us FIRC for the same.

So, if we use Paypal/Paisapay for receiving payment from International Buyers then it can not be considered as LEGAL as Paypal or Paisapay both are not Authorized dealer and none of them issue FIRC.

Moreover it’s the clear cut case of fraud as most of the sellers send the item sold through eBay as gift/Sample.

At last I will request all sellers to provide the legal ways of receiving payment and take utmost care that no misguiding advice is given.

So,I Request eBay to arrange a workshop for the issue raised above.

Any suggestion or advice is welcome.

Best Regards,
Deep Agarwal.

Dear Umangjee,

I am posting this for the paypal awarness. I think You better talk to your CA, and let me continue this with whom who are new or confused.

and from I know, This is not a illegal. If you required FIRC, then also you can apply with that, I am here not for the rules with RBI, I am here to guide you when how come you can attract new bussiness or buyers.

if you have more queries on this, please ask to expert. if you are not thininking me to guide you.

I have just word with my Bank Officer, and he told me that FIRC is your Requirement, not banks. If you want to claim that in DGMT, then only it requires, other then For indian Funds, You dont need FIRC.

Thank You,

Kind Regards.

Dear Sareewholesale,

IEC means, Import Export Code. They have their own Online Return to fill.

If you want to sell legally, then you need, IEC (Import export code)
Bank Dealer Code, (Issue by bank)
Business registration proof
Bank details.

My Forefather was selling offline dear sir. But funds were the same. It’s not converting by years.

Gifting value should be 25,000 at a time. You may rise as much as invoices but if there are below 25k, then only not converts in commercial value.

I am telling you, that you have to raise the invoice about 25k, if its on commercial base. But if you want to send as a gift then, there is very diff other ways as well. If I will disclose then, there were so many sellers like who have honesty with them, will not support this issue. Better we will send the request to the eBay for the workshop for Legal issues.

In one year, you cant send or receive more then 10,000 US $ on as gift value in your account. Up to 10,000 US $. You can send or receive without any problem with bank. As on gift. That’s the RBI rule.

About 100 Years of Selling, I am just 7 years old in this eBay. But knowing too much things on E-commerce frauds and Legalese and transactions, I have 30 Reg Sites in India, where I am dealing with. And 458 sites from out of India, where I am dealing in Cell Phones and Books.

Thank You,

Kind Regards,
Chinmay Tripathi.

Hi,
It seems like the discussion on the topic of FIRC has outlived on this thread. The workshop host has clarified his thoughts on this topic. I am sure the workshop host (niceshop4u) has given the information to the best of his knowledge. I appreciate that some sellers might not agree with the host. However, I will request all to maintain the basic decorum of the forum and the community value of believing that everyone has something to contribute.

I shall be removing the posts which I feel are not in the right spirit of the discussion. Thanks for your understanding and cooperation!

Sapana
