I had put up one Motherboard which was defective for sale. I had mentioned in my description that item is defective and non functional. One of buyer bought without reading the description and now he is saying that I have cheated him and done fraud. The only mistake I did that i had put similar model picture with my listing.

As Seller am I Fraud.

As far as i can tell you clearly had mala-fide intentions while listing that non-functional motherboard for sale. I say this because:

1) The description says that the mobo is non-functional in extremely tiny font at the end of the listing (which everyone except experienced ebayers will miss).
2) You have put no information about the actual mobo (date of purchase etc.) in the actual listing.
3) All 3 pictures posted with your listing show different motherboards and there is no picture of what the buyer will actually get.

I hope you do the right thing and refund the buyer the entire cost. You might not have intended to cheat the buyer but knowingly or unknowingly you clearly have committed fraud.

I want to ask you the forum about their opinion about the service industry in India. If forum feels I am fraud then the whole Indian Service industry is a biggest fraud. For Example: We see lot of mouth watering offers like in case of Maruti Offer. The saying that get Rs 44,000 for your old in exchange but in small letters which is hardly visible to any intellectual cant even read the terms and condition. And If go with mindset that I can exchange my 15 yrs old fiat for Maruti and they said we will only give Rs. 2,500 in exchange. Now what call this. There are many like these I can give 100 of examples. Is this mean Maruti is a fraud and cheat ? Answer this.

Your intention of cheating is clear from your answer itself.

You have deliberately put the remarks in small fonts, inorder to cheat.

You have done a mistake and instead of making amends you are trying to justify the act.

dear all ,

Buyer must avoide such listings with cheap low values then market .

Before buying always ask any daughts from seller , it will keep transaction clear.

ebay should check the listing before posing , i hope its mistake of seller .

refund is must in such case .

Then this means that Maruti Udyog Ltd has cheated me and done a big fraud with me. ICICI Bank told me that you get credit card free and from this year they charged me Renewal Fees. So according to community ICICI Bank is a cheat and fraud did not inform me that credit card was free for one year only.

If you feell the above companies are cheat and fraud I am ready to admit my mistake.

Why does community have double standards. The buyer is at mistake he should have contacted me for his doubts.

In fact I gave call to him before sending the invoice and informed him about the product. Still he paid for it.

Does community still feels that I have cheated ? Please reply:

I hope you know the difference between false/misleading advertising and fraud - when Maruti tells you they'll give you 44,000 rupees for your old car with a "conditions apply" at the bottom or when you walk into a store seeing the "upto 50% off" sign on the window thats misleading advertising - meant entirely to lure the buyers but the buyers on finding the truth when they go to make the purchase either walk away or choose to buy as per their will.

On the other hand what you've done is similar to Maruti having sold you a car without a engine and then trying to justify their actions by saying that it was written in tiny font at the end of the fancy brochure that they handed you that this car doesn't have an engine. Some things are taken by the buyers for granted (in you case a working mobo since you're charging for the same and have copy pasted the specs from the website) and violating those conditions is clearly fraud.

Next being totally fair to you, banks as entities are known to be fiercely aggressive in their marketing and always rely upon - The customer didn't ask so we didn't tell while all the time keeping the tiny conditions apply motif at the bottom to keep them predominantly safe from legal complications which is somewhat similar to what you've done.

Unfortunately for you, you've gone a step ahead and given the customer an entirely non-functional motherboard as compared to say not delivering all of what the listing promised - as you might hae figured fraud has various degrees and you've right near the top (only thing worse would be not giving anything at all).

Luckily for most sellers like yourselves that cheat on online websites generally due to the relatively small amount of money involved + complications due to buyer and seller being in different cities they get away with it.

The buyer in such cases has only the feedback as a tool available to him immediately as most don't even know or want to get into the long and tedious eBay dispute process.
The community on the other hand loses a genuine paying buyer who would probably not buy on eBay again (and tell others not to as well) thus your actions affect the entire selling community.

clearly you are a cheat and fraud, also you have done it intentionally, also you are a very experienced seller , so you know the tricks, as this is not your only account , you have other accounts also with almost 1000 feed backs ,
