PaisaPay acting outside its JURISDICTION by holding payments.

Dears,
I have been selling on Ebay for more than a year now. As a seller I am aware of Chargebacks quite well as I have received a few of them.
When I did not receive my Nov 28 cheque till 8 Dec, I contacted Customer Support and they confirmed that my payment was on hold for '''periodical review'''. This is a very important term they are using. Then yesterday I went through the whole of Ebay-PaisaPay policy but it was nowhere mentioned that a Seller's weekly payment could be put on hold. The only reason mentioned there in Clause 3c for such an event was a 'CHARGEBACK greater than the PaisaPay account balance'.
When I applied this to my situation (Chargeback of around Rs. 900 and a payment of 21,000 plus held back), I could see this as a clear voilation of PaisaPay policy.

Then this morning I had a long chat with the LIVE Help man. He too accepted that in PaisaPay policy it was nowhere mentioned that such reviews could be carried.
Given below is an excerpt:

Karan: How may I help you today?
bestofkashmir: Hi, my PaisaPay payment cheque has been put on hold from 28 Nov. They are asking for Proof of Delivery without specifying any reason. As per PaisaPay policy Clause 3C, payments can be put on hold only when there is a Chargeback on that account greater than the total balance. In case the balance is more, the chargeback amount shall be deducted from the available balance. So the PaisaPay team has clearly voilated this Clause!
Karan: AS your payment is on hold you have been asked for the Proof Of Delivery as the PaisaPay team would be reviewing your account.
Karan: Once you provide the same be rest assured we would accordingly guide you further with the payment.
bestofkashmir: But they can put payments on hold for one reason only as per PaisaPay policy?
bestofkashmir: That is when there is a chargeback greater than the available balance.
bestofkashmir: There is no mention of some review going on at any time of the year.
Karan: The PaisaPay team does have such reviews for the PaisaPay accounts of the sellers.
bestofkashmir: Hey Are you there?
Karan: AS you would have shipped the item you can provide us the Proof Of Delivery and we would guide you further with the payments.
bestofkashmir: And is it mentioned in the PaisaPay policy?
Karan: Are you getting my messages?
bestofkashmir: Yes
bestofkashmir: Why was I not reminded even when I am a Power Seller?
Karan: You would have received an intimation from our PaisaPay team.
bestofkashmir: None was received If you have send any please provide some proof
Karan: Sure
bestofkashmir: You did not answer if the PaisaPay team has the jurisdiction to conduct this review thing under PaisaPay policy?
bestofkashmir: It seems this review thing was invented!
Karan: Please understand that this is a periodical review conducted by the PaisaPay team.
bestofkashmir: You are not answering the question.
bestofkashmir: Does PaisaPay policy allow this revied?
bestofkashmir: Review, I mean
bestofkashmir: Are you there?
Karan: Yes
bestofkashmir: So?
Karan: It is not mentioned in the policies as this is specific to every individual account.

bestofkashmir: Look! We are debating PaisaPay policy voilation here. I need to talk to someone who is quite knowledgeable about the same. I don't doubt your credentials but you have your limitations as you said earlier. So kindly connect me to someone else ASAP
bestofkashmir: I started this chat in the morning only afer going through the PaisaPay policy thoroughly yesterday
Karan: I understand this has not been mentioned in the policy however this has been carried out for many seller PaisaPay accounts.
bestofkashmir: That is the point. They have been suffering for lack of knowledge of PaisaPay policy. I won't be buckling under pressure even if you were to hold my payment forever.
bestofkashmir: Ebay is not a Government department and I shall try to do my best to prevent it behaving that way.
Karan: This is the best I can do for you at the moment.
Karan: You may wish to wait to hear from the PaisaPay team directly on this.

Wow, this is exactly what has happened to me recently.

About 20 days back they started this REVIEW thing on my account and since then, it's in that process.

The amazing thing is that the BUYER has left a very positive feedback already a long time back. However, looks like PaisaPay would like to do things in their own pleasing ways.

And as if that wasn't enough, I get one other ALERT yesterday saying "PaisaPay outbound payments suspended". Reason? Some Ebay policy has been violated by me.

What policy? No idea ๐Ÿ˜ž

Become Sherlock homes and solve the mystery! I mean, I'm relatively a new seller on Ebay and am I not eligible for at least one WARNING or something before directly SUSPENDING my account? Canโ€™t they be kind enough to update me on the thing Iโ€™m doing wrong and if I donโ€™t take ACTIONโ€ฆ by all means, S**** me?!?!

Same with me. They have hold my payments sincce 24.06.2006:

I have received some chargebacks for Rs. 7500 for which I have faxed the required PODs. I have been chasing them since 1 month now and everytime I receive a reply under periodical review they need some more time.

Even I tried to talk and after talking came back with the same reply.

Just think a huge amount of mine is stuck and I had no other option rather than withdrawing my listings. I have also gone through their policy and nowhere it is mentioned that they can hold payments for any cause whether periodical review or chargebacks.

Due to some personal problems I was unable to take any suitable action against them, but now I have taken the folowing 2 steps against eBay:

1. I have informed this irresponsibility and unlawful act of Paisapay to RBI by logging on their site:

http://www.rbi.org.in/scripts/helpdesk.aspx

and sent them a mail in writing to :

and

Shri Ashok Kumar Jha

2. Secondly I am taken legal action by firstly lodging an FIR with local police station about Fraudery of eBay and secondly have hired an advocate to deal necessary legal proceedings.

Hello,
Well I got another point. PaisaPay started the review by saying that my Nov 28 payment is on hold. But couple of days back they mailed that the next two payments of 5 Dec and 12 Dec amounting to approx. Rs. 1,25,000.
Again they are requesting for PODs.

I wish to ask why can't they mention the PaisaPay IDs for the PODs they want?

MORE IMPORTANTLY, as Sellers we are told to ship items for confirmed payments only and that is what all of us have done in these cases. SO HOW CAN WE TRUST PAISAPAY IN FUTURE when such reviews are carried out for confirmed payments?
WHAT DID THEY CONFIRM IN THE FIRST PLACE THEN?

Also, I have decided to shift to PayPal immediately, although the cheques they send are outstation and may take me extra time to clear, but at least I'll get my money, God willing.
PayPal cheques are at-par with all CitiBank branches, so you should try to switch to it in case you wish for some other alternative.

Hi Shahnawaz,

I am very disappointed to learn about your grave experience with eBay. I fully sympathize and agree with you.

I have been using PaisaPay payments for long, but after what happened in your case I am beginning to feel some discomfort using it. I believe the real cause of this problem lies beneath the Banking system that PaisaPay ties-up with. What startles me most is that the eBay support-guys (who I believe have all the inputs when they write/speak to you) do not give any conclusive or definitive reply. Seems like they take us for granted.

Anyhow, please do keep posted if you manage to get any response from PaisaPay team. And, since u have been using paypal, can u plz tell me whether there are any recurring fees (like $100 or so) every time you ask them to issue a cheque?

Hello digital_das,
I was suspended immediately after (I provided the proof of shipment and) restoration of PaisaPay outbound payments. Through the period of suspension, I came to know about lots of important things including WHY & HOW PayPal is the fastest & easiest payment option even for INDIAN Buyers/ Sellers.
If you were to withdraw paypal balance thru cheque, there is a withdrawal fee of 5 USD. However, I came to know about a better option (www.xoom.com) whereby your PayPal payment is in your Bank account within 2-3 days. Wow! how terrible PaisaPay used to be and I thought it was the easiest for Indians; how wrong I was! As they say (Kashmiri proverb): "Bekhabar gav Qahr-e-khuda", which means "The Unware is like God's curse".

Dear All,
i also ncountered a same one withe me now,they sent me a messgae of my paisapay account suspension for some viloation of policy,but i didn't get the exact reason,for why i was been suspended ,now my 61000 INR or more were been stucked in paisapay,
actually they should guide us time by time untill we get the right way for our listings and all payment stuff,
we are all here for some more conviniece to do our business globally ,but unfortunately we encountered this disturbance who must pay by us with lot of extra stress and efforts at the cost of our business here,
God may help us,

if possible guide me to resolve with this issue,either i will not more on ebay to do the things 'online listings',

Hello,
You should fax a copy of all the courier receipts for the suspended payments to Ebay. They would have already provided the fax number.
I stopped using PaisaPay since I had this experience. PayPal is far better as i found out.
When, God willing, your payment is restored please feel free to ask about the PayPal details if required; AND as i learnt these experiences should make us stronger. So best wishes to you and do stay strong.

Hello Shahnawaz !

I feel extremely lucky after hearing all of your ordeal that the amount is just 182 Rs !

Here is what happened !

26-Feb - Notification Of Payment from buyer via PaisaPay
1-Mar - I shipped the Item since I received the Notification
5-Mar - I noticed that the PaisaPay Id is removed from the checkout page(order detail page)
5-Mar - I contacted customer support and asked the details.
5-Mar - I received this reply from PaisaPay



Hello,

This mail is in regards with the PaisaPay ID:19092970397 for which you
have received the demand draft and is showing up in your PaisaPay
Account as payment sent.

I wish to inform you that due to technical error the transaction for the
above mentioned PaisaPay Id was declined and the amount for the same has
been refunded to the buyer.

Hence I request you to kindly do not ship the item to the buyer as buyer
has been refunded for the amount which will be adjusted in your next
PaisaPay payment cycle.

For further clarification please feel free to get back to us. I regret
for the inconvenience caused.

I got this response only after I contact PaisaPay, If the Payment was declined why didn't they inform me ??

The shocker is yet to come :-

06-Mar - I received this refund notice

An amount of Rs. 182.39 has been recovered from your PaisaPay Account as

following reason: Refund: Other(Refunded as per seller)

THE SHOCKING THING IS HOW FRAUDULENTLY THEY HAVE PUT THE REASON "Refund: Other"(Refunded as per seller) WHILE IN THE LAST MAIL THEY HAVE SAID IT WAS THEIR TECHNICAL FAULT !

Hello Shyam,
Well, the last point you mentioned is the most important: "PaisaPay never informed you!". That happened with me as well. And all through my suspension, I was annoyed the most with steroetype answers from all EBAY STAFF: from Customer Support to the Top Seller Managers. I even wrote to the Ebay India Head and Incharge Trust & Safety, Sharat Digumatri. The response was a couple of phone calls reminding me the same thing I was told by Customer Support through email.
What I really want to say is that THE HELP FROM EBAY WAS MINIMAL AND MADE ME FEEL LIKE I WAS "Om Puri" in the movie "Current" where he tries everything to restore his electric connection (disconnected without NOTICE!) to water his fields.
I would ask myself at times "Man! These Ebay guys think they are Government employees!".
