ebay - paypal cheat : How to file a case in court? or recollect the amount?

Hi,
I bought a laptop key pad from yallstore.com through ebay.
But he gave me a USPS tracking number (which say "Item yet to be picked up") and it was not in yet to be picked for the 30 days.

1) I raised strike in ebay
2) Raised a dispute in PayPal
3) The seller asked me to close the Paypal dispute request as it will take more time to solve the issue.
He will repay immediately,
4) Trusting him, I closed the dispute request in PayPal, but the seller (Yallstore.com) cheated me and he did not refund the amount.

Issue,
1) I cannot re-open the issue in paypal
2) Ebay is not showing my item as it crossed 60 days.

Conclusion,
Ebay tied up with Paypal to cheat the people and might get bigger amount from the seller.

Someone help me file a case against ebay and PayPal please.

I had a similar experience...I purchase a nintendo wii from vavashop.....they sent me a nintendo wii box with 2 hardback books inside. Their email address and phone # was invalid. I got the address off the label on the box and searched the internet for a phone #...I called them up...what a shock they had when I phoned...they didn't expect it...anyway...after fighting with paypal....I found out that vavashop was also doing some postal fraud...I got a detective and a postal inspector involved....this is still ongoing....paypal said I have to ship the parcel back to the seller...it will cost me $16 to ship an empty box back......I will lose that money.....I will have to go to my credit card company for the retrieval of my money.....this is a power seller...he should be banned from trading on ebay. Turns out he resold my wii to someone else.....AVOID VAVASHOP AT ALL COSTS. If you need more information....contact me

Dear if you paid thru credit card file chargeback by calling yr credit card company immediatly telling them merchant did not shipped yr item. "Lord, I have done many things wrong. I had also purchased the Pendrive 32 GB from ebay. the seller had supplied me Duplicate pendrive. I came to know when i visited the service center of the company.
The Ebay says we can't help you. we can give you the contact numbers of seller. The seller is not amswering on mobile number provided by ebay to me. I am fed up from all this. Now, I am going to sue the Ebay as well as seller for doing this fraud with me. I had paid money to ebay, I know ebay not the seller sitting in Chennai. the originality of product should be taken care by the ebay. In mine view, ebay had taken money from the seller for selling the duplicate product on website.

@nitin_sood77 First of all sorry to hear about your bad experience. Please do not go for cheap items. Some sellers on eBay are selling 8GB Pen Drives as 32GB Pen Drives. A genuine 32GB Pen Drive cost more than that they sell on eBay. Mostly cheated are the new buyers. My personal advice to you will be to read the eBay Forums regularly and learn from other peoples experience.
