hello sir/madam,

please look into the matter we have purchased one material from ebay india the details are as under

Item title: Black & Decker 2 Litre Cool Touch Deep Fryer

Total: Rs. 6,400.00

when we purchased this product we have given payment throuch paisa pay.com after one week we received the material but it was not up to our satisfaction and it is second hand although on site it is described as a new, when we write to brand deal they are not ready to accept that the problem is with product after their request we sended material for refund,they said that the product is new and no problem with the unit, but we have seen that the productis used one and it is not working ok.

after this all we have contacted to ebay customer care but only computer generated answers we get, nothing else and also there is no answer from brand deal. we dont have direct email contact to ebay where we can complaint directly to ebay.

we have purchased one product from ebay and we want its refund back by any how. we have said to branddeal that we are going to take legal actions against him we want justice and our payment back.

so please look into the matter and solve it on urgent basis.

this issue is pending from last threee months

Hi,

If you have opened a dispute of Item Significantly Not As Described within 60 days of the end of listing then you are liable to get full refund ( less Rs.50 ) from ebay. If not, then it may be too late to follow this proceedure. Hope someone from eBay will address your problem and take appropriate actions.

probably you should contact the seller about this issue and about contacting ebay we have contacted ebay customer care in time but there is no response from ebay only computer generated email is coming to us. we are been fade up with contacting brand deal and ebay, ebay must communicate with seller brand deal about this issue, we want our payment immediately, we have done the business with ebay and not with brand deal only, we have trusted ebay, but we think that no one in ebay is listing to customers. we are being very disappointed with the ebay and brand deal approach.

please give us positive and early reply.

The product sent to you is a brand new one with warranty.



You said that it is broken, but I can't see any broken stuff. I can't even see anything that is cracked forget about it getting broken.



The same item was sent to you which was shown in the web site. I don't understand what the problem is.



In all your mails you try to threaten me about complaints and legal procedures.


I have checked the product and it is working properly. It is unused and brand new. 



I have informed you about this earlier and also said that I can send the item to you again, and then also you tried to threatening me saying that I will open it in front of the court with 2 witness a lawyer and judge and YOU SAID THAT YOU WANT A LAWYERS CONFIRMATION ALONG WITH EBAY LETTER THAT THE PRODUCT IS BRAND NEW. I cannot waste that much time getting a lawyers confirmation
with eBay letter.



I am giving you a bill with one year warranty, that's all you can get.



If you want I can send the product back to you and you can follow whatever legal procedures you want.

well this brand deal is a real cheat guys. they simply advertise a low price for any model tempting u to go for it. then after u have paid they sit tight and mail back stating that there is no stock or old stock or the piece is defective. then they ask u to look at other costly products to adjust the amount u have already paid. this is there cheap modus operandi which will not last long. i have there fore slammed a negative rating to them as i have not yet got a refund of the amount i had paid for a particular item put up for sale by them.

All the policies are not implemented practically. First of all ebay is not active in resolving the issues.

Claim 1674042 raised in June. Story is the buyer says he has sent an email for refund , ebay says they didnt receive. It's the buyer who has to all middle tier operation even when there is a dispute opened.
My experiences are worst with ebay India. Many people in the thread has suggested to do dont confirm receipt of the item and file a dispute .. etc
1. If you dont confirm receipt of the item and even send it back to the buyer and have a dispute opened for that, still ebay calls you and asks you whether you have received the item, even you say you have opened a dispute and have sent the item back, the people dont care about that and forcefully marks the item as received.After waiting for 1 month I escalated to claim , now its over 1 month again , ebay has sent a mail just saying that seller has agreed to refund (even though he was saying the same thing for 1 month) so the claim is temporarily closed and seller is allowed to refund the amount in 2-3 weeks. Its the buyers money which is involved and they dont really act as a professional.They are like regular govt offices where in people have to roam around the desks.
Maybe buyer can get his money back , but if that money is not coming in the time it has to, the purpose of buyer protection is defeated.

I have sent an email to indraneel@ebay.com hoping that somebody will see things moving.No response till now.
