cheated by seller

the seller has cheated me by sending the motorola v3i not as described .
i was promised to be provided with a silver color cell phone .. he sent me a white one
secondly i was promised to send a new headphone thats of motorola v3i ..along with the box ..but it is a single ear plug ..old used headphone
and the charger is not of indian standerds
and the usb cable also doesnt support

plz tell me how to sue the seller

please file claim against cheater sellers - item not as described ..make sure u send the item back and have proof. And speak to ebay team and complain.

Always, remember to buy from good Sellers (see feedback and his sales count of that item you like to buy and overall sales) even though there is a little increase in price. Inquire the Seller if he can provide better product, service if you pay more price. Talk atleast once to the Seller to understand his tone and way of speech before placing order especially when you are placing order for high worth items.

Current case,
You may need to talk to Seller once and seek his solutions first.
If he don't cooperate, have full evidence in photos and then submit to inrswebhelp@ebay.com and ask them to open SNAD case. Buyer is just equal as Seller, hope you are true as Buyer, you will get justice. But be true.

I think you can return and get refund if the deal is not impressive. Seller generally accepts. Hope you will have your day.

Don't break your head over this its a GEB item. Apply for a refund.

Some sellers do it purposely knowing that it is expensive for the buyer to ship it back.
One seller sent a replica Casio watch, despite the listing being removed by trust and safety and being told not to ship the item.
Another seller with a feedback of more than 1000+ has sent a 250 GB hard drive instead of the 320 GB hard drive I had paid for.

Wished sellers were more responsible. I would be happy and so will other buyers on ebay if the sellers are monitored better. I have faced a similar issue like this just yesterday. I was sent the wrong product and not the one shown on their product listing and to top it all, the product is defective and now when asked about replacing it Iam asked to ship it back to him, now if I really had the time and energy to go out and the shipping I would rather step out of home and just go the store in my city and get it and do away with all this trouble and surprises. Guess what when I asked the seller to send me the replacement he calls me cheap and that Iam coning him to get 2 for 1 lol! The product costs Rs.315 handsfree for my iphone.
