I AM PINACK HALAIE (49 YRS OLD)

WHEN EBAY WAS BAAZEE.COM I WAS A SUPER SELLER IN BETWEEN 2001-2004 FOR FEW MONTHS.

AT THAT TIME, SELLERS RECEIVE FULL PAYMENT IN ADVANCE FROM BUYERS & THEN WE DISPATCH THE PRODUCT THIS WAS THE PROCEDURE SO FEW SELLER CHEATED BUYERS BY NOT DISPATCHING THE PRODUCT AFTER RECEIVING FULL PAYMENT.

THATS WHY MANY BUYERS LOST TRUST ON BAAZEE.COM & THEN BAAZEE.COM CHANGED TO EBAY.IN (MAY BE EBAY.COM PURCHASED BAAZEE.COM I DONT KNOW WHATS THE REASON BUT EBAY.COM IS VERY OLD & SUCCESSFUL SITE) EBAY.IN WAS STARTED WITH ALL THESE NEW RULES & POLICIES.

THIS JAN 2010 I PURCHASED A COSTLY MOBILE BUT DUE TO SOME REASON I WANTED TO SELL IT SO I THOUGHT I SHOULD TRY TO SELL ON EBAY.IN I LISTED 1ST TIME NOT SOLD, 2ND TIME SOLD BUT NEW USER NOT PAID FOR IT SAME 3RD TIME & FINALLY AFTER RE LISTING 4TH TIME I GOT A BUYER WITH 65 FEEDBACKS.

HE MAILED ME THRU ASKING QUESTIONS ON EBAY AND WE DISCUSSED EVERYTHING HE WANTED TO KNOW ABOUT THE PRODUCT, HE TOLD ME NOT TO MENTION MOBILE IN COURIER DECLARATION EVER PLEASE CALL ME I WILL EXPLAIN YOU WHAT TO DO THEN I WILL MAKE THE PAYMENT.

WHEN I CALLED HIM UP HE TOLD ME THAT MENTION A ELECTRONIC ITEM IN DECLARATION FORM & PUT THE VALUE BELOW 1000 ETC ETC I THOUGHT HE WANTS TO TAKE A FALSE CLAIM SO I CALLED EBAY HELP LINE & INFORMED THEM ABOUT THE BUYER.

HE TOLD ME THAT HE WANT TO GIFT THIS TO HIS FRIEND PLEASE SEND IMMEDIATELY SO I DID THE SAME IN HURRY I FORGOT TO SEND 8GB CARD MENTIONED IN LISTING SO I SENT HIM AGAIN AFTER RECEIVING HE WAS NOT ACCEPTING THE DELIVERY RECIEPT ON EBAY SO I CALLED HIM SENT MANY SMS FOR THE SAME BUT HE ASKED ME TO LEAVE A POSITIVE FEEDBACK 1ST AGAIN I DID WHAT HE ASKED AFTER 2 DAYS SUDDENLY HE ASKED ME FULL REFUND WHEN I REFUSED HE STARTED THREATENING ME THAT HE WILL FILE CASE AGAINST ME "I WILL GET REFUND AND THE MOBILE BOTH I AM WARNING YOU FOR THE LAST TIME" I REFUSED AGAIN SO HE FILED A CASE & I ESCALATED THE CASE TO EBAY WITH ALL THE PROOFS.

FINALLY I GOT RESPONSE AFTER 3-4DAYS THAT REFUND WAS NOT ISSUED TO THE BUYER YOU DONT NEED TO TAKE ANY ACTION.
SO HE LEFT A NEGATIVE FEEDBACK INTENSIONALLY BECUASE HE LOST THE CASE.

AFTER 8-10 DAYS I GOT A MESSAGE FROM EBAY THAT WE HAD ISSUED A REFUND TO THE BUYER & CLOSED THE CASE YOU DONT NEED TO TAKE ANY ACTION.

I CALLED CUSTOMER CARE, MAILED AT EVERY EMAIL ADDRESS I GOT FROM THE SITE BUT NO USE.

BUYER GOT FULL REFUND + MOBILE + POSITIVE FEEDBACK NOW HE IS SELLING THE SAME MOBILE ON EBAY WITHOUT DESCRIBING THE ITEM CONDITION.

I HAD GIVEN HIM BEST SERVICE POSSIBLE & IN RETURN I GOT NEGATIVE FEEDBACK + AROUND 2000 LOSS + WASTE OF TIME.

MY ACCOUNT WAS NOT DEBITED IS A GOOD THING BUT STILL FIGHTING FOR THE UNFAIR NEGATIVE FEEDBACK WHICH IS EFFECTING MY SALES.

EBAY TEAM / COMMUNITY COURT TEAM IS VERY CARELESS.

BUYERS TAKING ADVANTAGE OF EBAY POLICIES & SELLERS GETTING LOSS.

EBAY GIVES A FREE SWORD "BUYER PROTECTION ACT" WITH REGISTRATION TO ALL THE BUYERS WITH A HIDDEN MESSAGE THAT "GO FOR SELLER HUNT"

i am sympathetic with your experience, but to be honest, sellers in India are reaping what they sow. i and my mum recently bought many items from eBay international (not GEB) and we were amazed to find how smooth the transactions went. the items were as described and it was never a case of finding out what was skipped in the item description. the quality was as promised and any caveats were clearly mentioned in the item description (ex: it is an OEM version, that is why it is half the price of retail version). most of the sellers accept only Paypal and they actually discourage you from paying through other means.

mum was surprised to find that there is no provision to mark item as received on eBay international, and i had to explain to her that this is because money gets directly credited to seller's paypal account and then seller ships the item. she was like, phir bhi itna smooth transaction!?

if you hang around in these forums you will find more and more colorful cases of how sellers indulge in everything from shill-bidding to persuading buyers for sending DD instead of Paipsapay to the infamous seller's warranty to selling OEM hardware at near retail prices to sending sub-standard items. at the very least, there are only a handful of sellers who don't need to be called again and again from buyer's side to ensure smooth transaction.

i have been fortunate enough to have dealt with the cream of the crop sellers here, but i have also had to deal with such shady sellers. at eBay India you can't escape them.

eBay wouldn't have needed a system like Paisapay, where it has to hold on to buyer's money until the transaction is finished, if majority sellers had kept their dealings clean. again, there are some very good sellers here, but they are a minority.

so please don't be surprised if eBay India has the Buyer Protection.

with respect to your case, eBay usually bases its decision on proof of delivery. i was just wondering if you had provided eBay with the same. in that case, things should have gone in your favor.
