Ebay seller is a cheater and ebay is non-reponsive

I ordered for the purchase of a Sigmatel S90 dual sim mobile phone and paid through Paisapay (ID No.24477433327).The seller was Pareshwins. The item disaptched by the seller happened to be Sigmatel S90i dual sim mobile phone (not S90) which has much lower specifications. On complaining to the seller by email, with a copy to ebay, the seller asked for returning the item at my expenses and stated that the refund of money shall be after that. I do not agree. This would have been OK if I was not satisfied with the item which I had ordered. But once the seller has cheated me by sending a different item with much lower specifications, why should I bear the charges of returning it? Moreover, how can I trust such cheater and return the item giving him a chance of not refunding my money? The seller is neither ready to bear the charges of returning the item nor to refund the amount unless I send back the item. And, shamelessly, he also writes that he has done the same thing to other 15 customers but I am the only one who is feeling cheated! What an argument! This also confirms that he is a real cheater. Several e-mails have been exchanged between us and I have sent copy of each to ebay. But there is no response from ebay also. I have now given notice to both of them that I shall move a court of law claiming refund of amount, interest on that amount and compensation for harassment if I do not receive my money back by 10th July. And I am serious about it.

I would advise every prospective buyer at ebay site not to buy any item from this site. They are all cheaters and non-responsive to the woes of users.

Dear Sir,

S90i is enhanced model than s90. The seller did a mistake by sending you an upgraded model at the same cost. So you received latest phone with uppgraded firmware and features at the cost of S90.

I dont understand why you should be complaining. Pls define what is missing in the item which the seller promised and didnt deliver.

Also for any refund the buyer has to first send the item back to seller. How is the seller guranteed the item if he returns the money first. Pls think.

Sir,

We have respectfully mailed you many times that your entire amount will be refunded once you return the product to us.

You cannot get a refund while keeping the product with a promise to return it back.

In any case you have multiple protection from ebay as you have paid with PaisaPay.

Your total amount including shipping charges if any is guaranteed by PaisaPay.

However you need to return the product to us. Incase you feel courier is too big a hassle, just write us a note and we will have the product picked up.

but if you see carefully the buyer is less to be blamed and more blame goes to ebay for making such rules that encourages such buyers who "want to have the cake and eat it too" (Surely not all buyers).

As the number of buyers who do such an act of not sending the product back and asking for refund is ever increasing makes me wonder what happened to the so called "well read" class of Indian people. It seems now a days our junta cannot Read, Write, Talk.

I say this because the buyer does not:
1. Read the terms and conditions of sale.
2. If he is unhappy about some issue he does not write an email to the seller.
3. Does not lift the phone and talk to the seller.

In conclusion I think it is all a matter of convenience.

This reminds me of on old Hindi proverb "JISKI LATHI USKI BHAINS"

ebay market is changing

buyers are feeling like they are the rulers.we are the beggars here,


its ebay rule that we cant refund unless we cant get item back.

s90i is much better than s90.seller did big mistake sending u the better one.

he should be hanged till death.

why he alone??

we also should be with them as we are doing many mistake of this kind and this is the result.

ebay should do something fast for this or else it will be tooooooooooo late.

Hi. even i hav similar story now to tell.i bid for and won a diamond ring of 0.2 ts with 20 diamonds from pankaj diamonds.he delvrd one with 12 dimnds.as not interstd in refund ,wanted my original product so mailed the seller for replacemnt.however he replied bak to send bak item at my cost and he will refund bak purchase amt.i then went ahead and gav my genuine feedbak for the same.the seller then took my contact number from ebay and called me and said'wat replacement you want,if you go in market,they will charge you just making charges that much'.he also said 'send me bak the ring and il giv you refund after receiving bak the item but you delete the negative feedbak right now.i refused as i thot like you,there is no guarantee he really will refund bak,espclly as he already doesnt prove to be genuine person as he sent an inferior quality product and why should i pay for sending bak something wat was seller's mistake.so i told him i was not intrstd in refund.he said he will c regarding replacement then,but i need to send bak the item first and also immdiately erase negative feedbak also first! when i contactd paisa pay call center to complain regarding seller,they informed me to lodge a complain for refund of money .
im not intrstd in lodging complain and waiting for either refund or replacement now as it will require numerous mail followups and waste of my time .
i just want ebay to take notice against such sellers who advertise something and then deliver something else and then call up customers and threaten.

You can open a dispute in the resolution centre in the following category:

"I received an item that does not match the seller's description"

If the seller does not address your problem, the dispute can be escalated by you to a claim from eBay. If the fault of seller is proved, eBay will refund you money and get the same deducted from the seller.Process is simple.

It is very surprising that seller is not ready to bear shipping charges, even though it appears that he is clearly at fault.
