Ebay is cheating me!!

I placed an order for an item and paid the money in advance. The item has not been delivered to me till now but Ebay claims that it is donw without giving any related evidence to me. Now they want me to prove that I have not got item till. Absolutely ridiculous. Claim personnel is also avoiding me. What should I do?

This is an outright case of cheating. Should I go to police or shall I go to consumer court?

Give item details and item number, give AWB number provided by the seller for this item. Give all details.

I raised refund request for this but it was rejected without consulting me. Ebay claims that seller provided sufficient to them but when I asked for same document to seller and Ebay they are not giving any response.
