Ebay Guarantee Claims True or Just for Namesake?

I purchased a 21 pcs magic bullet on ebay on 8th August 2012
I received the product on 16th August 2012 and found that product was faulty. I informed the seller immediately over phone and he agreed for a refund
I chatted with a customer support person on Ebay on 17th August 2012 to inquire that who would bear the reshipment charges
He asked me to raise a claim and i raised a claim no 113440 on the same day;although that claim is not listed in my resolution center
I chatted the customer support guys on 21st, 23rd and 28th august and they always assured that the claim adjuster would contact us
It never happened after my constant followup I got a mail finally on 6th Sept 2012 that i should ship back the product in next 5 days else the claim would be settled in seller's favour. Just 5 days for me where to revert where as you took around 20 days
It took a lot of effort for me to locate a courier company which ships the electronic items
Just what kind of irresponsible behavior is this from support staff?
The mental agony and harassment it created is irreversible
The eBay guarantee states a claim would be settled within 7 days but this case is clear example on how serious is Ebay for customer satisfaction and help
I am extremely disappointed by this and just need an answer to this
Why shouldn't I go to consumer agencies to take compensation for my mental agony and pain in terms of service faliure on Ebay's part?

Have you contacted the seller before raising the claim ?
Please understand the basics of eBay. You must check with your seller first regarding all the problems.
Seller will try to resolve your problem. If u find seller unable to resolve, please then contact eBay support and surely they will help you out. Best Regards

Same is the case with me, I ordered a Mouse but Seller sent me a Different model and That was defective and a Used one..
I asked to seller, Seller said He will Reship the Item that was ordered, He kept fooling me for 7 days and did not ship the Item then he started not to receive any of my calls....
Now I raised claim on eBay, same situation now, No solution, No replacement, No refund....
eBay and sellers cheated me, If they don't care for me and I don't get refund then I am gonna take revenge, I will spoil their Image all over the internet....

once you raised a case , you are safe either you get your replacement or refund.
but it takes time about a month sadly.
