Ebay Cheated me now what to do

I brought a product from my ebay(my first product)
Seller delivered it in broken state...I raised a complain ebay suggested me to return it back assuring that ebay will return me courier charges in 15 days....I did as they suggested. Now it has been more than 45 days, 2-3 written complain.....1 telephonic complaint....but no body is replying or doing anything....Now what impression should i make......
It was totally horrible experience.....will not recommend ebay to anyone for two reasons
1) Indian sellers on ebay are not professional and hard to trust...so it frustrates
2) Ebay customer care.....

Seller: ewarld is very slow and irresponsible seller

i my self have purchase hosting space from him on 30/8/2010

On the same day he enter shipping details and till now i have not got anything

I have send him 10 reminder from ebay and to his email id

Last email he told will be done in 24 hours but till now its around 48 hours but still dont care

Waiting for paisapay time line

He have recd 17 negative feedback in just 1 month

But he fixed my issue but problem is from ebay support...
THEY ARE NOT REIMBURSING SHIPMENT CHARGES...which they committed earlier....

as a seller i dont want to give negative to ewarld but still he dont reply and not resolving the issue

Complain where?
Ebay support sucks big time!!!!!!
How easy or difficult it is btw to go to consumer court?

I have done it many times but they are not replying...even called their customer care center but it again was of no use

this is happening to every one please ebay dont put big banners return peoples money dont cheat first of all trust on ebay is no more then this is stinking mr yogesh this is to you to return my courier charges or else keep it as a gift
