As part of monsoon gift i received a totally used gift form Ebay

Hello can any one help me?
I done a transaction of abouve 30,000/- and claimed a gift Kodak c195(PPID-29437371029)
Yesterday(01/08/2011) i received the gift and when i open the outer box i found there was no seal and a cello tape on put on.
Inside i found two AA cells (one of Duracell & one Kodak) both drained totally, no memory card, as on box its mentioned its with charger & 2gb card but both missing. I put a new AA cells and switched ON the camera. When i pressed PLAY button i found two photos also, which they might have forgot to delete.
I received this Camera from "Bertelsmann Marketing Service India Pvt. Limited"
Invoice No: EBAYSINV16788 Date: 29-07-11

I want to ask ebay if you are giving gifts to members then give brand new gifts why used ones?
I spoken to ebay customer care and i got a answer that they cant help.. why?

Hey man, good you got this on the forum. This is totally unacceptable and ebay should personally apologize to you in writing for this fiasco and should compensated you for this metal agony. They cannot treat buyers like this.

I think even ebay is unaware that how his 3rd party seller
"Bertelsmann Marketing Service India Pvt. Limited" is treating with the gifts.
I came to know that ebay is not handling this gifting products and its handled by 3rd party.

They must have been doing this from a long time, taking the gifts to their home or giving it to their friends to use it and after that, they will pack it and send it as a ebay gift....who bothers. This might be the reason some people dosent receive the gifts or get too much delayed.
If ebay is aware of this then its a big shame on ebay and ebay should stop this gifting schemes rather that playing with others feelings.

Yesterday morning i received a call Mr.Ritesh from Bertelsmann Marketing Services India Pvt, asking me to ship the old received camera and by evening i shipped the camera using DTDC courier docket details are B74115560 dated 11/08/2011.
They said"We shall replace and ship another camera within the 5 days of receiving packet from you."
So again 5 days.. iam happy because iam getting a replacement.

Finally i received the a Brand New Camera from Ebay.
It took almost a month but happy that i got a replacement.
