What to do when a seller delivers a **bleep** but Ebay disowns their responsibility?

I bought a Tab (iberry Corex 😎 costing Rs 23990 on 8/2/2014. In fact I was deceived by a smart advertisement on the site. The product was found to be of extremely poor quality (pathetic to say the least). Its camera simply refuses to work when it has to, audio is primitive and battery is just not enough to say it has one! How on earth can anyone CHEAT like this?

 

Once I realised I was taken for a ride by iberry with the help of Ebay I filed a refund claim. Ebay however replied that I was not eligible for a refund as the manufacturer provides one year warranty!. What warranty one requires when the buyer is cheated of his money? I have never been cheated in such a way by anyone since a pick-pocket stole my purse and some valuables 10 years ago.

 

More than the money I lost what hurts me is the fact that a site like Ebay stands not with the cheated buyer but with the cheater.

The Tab has since been dumped at iberry's Trivandrum service centre (something that truly matches the quality of the product) for the last 3 days. I have not heard anything from the service centre since then -- no calls, no SMS, nothing whatsoever -- truly amazing service from a centre where they did not even have a USB cable to connect the device to a computer!

 

I'm planning to sue the seller as well as Ebay in this regard. 

Can anyone advise me as how to proceed in this case?

don't have a clue what to suggest. but never mind, i'd like to place the blame on you in the first place.

why, why, and why do you guys buy something like this product or anything electronic or so from a site

you don't know much about? don't you have some good shop nearby? i deal in coolectibles, and i'm

ebaying for a long while now---trust me, never in my life will i ever buy some watch or camera or mobile

or a car and all from ebay. who is or what is ebay actually? a a bay where the sharks and fishermen and

lots of cute little fish have a get together. now what responsibility do you want the silly bay to bear if a shark

eats a fisherman up while he is busy fishing?

 

sorry, i don't mean to hurt you---just asking to think rational. you buy things that aren't available at nearby

shops, or you buy books cuz you got cheaper rates, i understand. but a costly electronic item, from god

knows what type of a person---is that a smart act? sure its practical in the usa or europe, but india is still

lagging far farrrr behind----we need to wait another 50 or 100 years to have the guts and confidence to buy

'anything and everything' online.

 

anyways, perhaps you should try to talk to customer support, and learn more about the transaction and see

if there is any way to go through this ugly thing. if nothing works, you can try a consumers court. all the best.
