What do you do when you feel cheated by Indian Seller?

Hello Ebay Community!

 

We bought a new phone for someone in India, from an Ebay seller (name witheld for now) in India a few months ago. We immediately noticed a problem with the screen and contacted the seller.

 

He indicated that it was covered by the manufacturer's warranttee and referred us to a place for replacement or repair. We were turned down and he said that we went to the wrong place. We contacted Ebay and they wanted to know if we would prefer to receive full refund or have the item repair or replaced. We chose to have the item repair/replaced. With Ebay's help, the seller accepted the item and promised replacing it at the earliest possibility. 

 

We expected a replacement in a matter of days or weeks, but it has taken several months and we are yet to receive the phone back. We spoke to him by phone a few times and he promised replacing the item but never kept any of his promises. We have made several attempts to reach the seller by phone in the last months, but we get someone that only speaks a language we do not understand. We have sent text messages without any response. We have sent Emails, and messages through Ebay messaging system without response.

 

We recently contacted Ebay for help and they replied to say that the seller is active on Ebay and that we need to communicate with the seller directly. They seem to stay away from matters that are older than 30 days old?!

 

It is late for a chargeback. Ebay is not helping. The seller is active on Ebay but he does not respond to our text messages and we are not reaching him by phone. Does anyone have any experience on what to do? 

 

The Seller was very friendly in the beginning and delivered the order promptly. We actually left a positive feedback about him before our unpleasant experience. We have met several honest people in India and we want to treasure the positive impression. Writing negative review about a company is something that we prefer to avoid.

 

The phone is not a very expensive one but we feel cheated and think that we must warn others. We feel that he must replace the phone or refund our money.

 

How do we make the seller replace the phone or refund the money?
