Ebay Claim Policy- What to Do?

This is in reference to two orders combined together. I had placed order for 40EH5000 TV (PaisaPayID:33346196725) on 21/03/2013 which was not delivered to me. I had raised the claim (claimID:193912) for which the seller responded to give me replacement item (42EH5000) with additional payment of Rs2800 (PaisapayID:33508501295). The claimID:193912 was closed even before I received the replacement product which is not as per Ebay policy.Now I cannot raise any claim for PaisaPay ID:33346196725 as there is already one claim against it and the transaction date is also beyond 45 days.

I received the replacement item 42EH5000 LED TV on 22nd April 2013 but the TV was defective and I informed the same to seller. He agreed that the TV is faulty but has put the blame on BlueDart and forwarded my request to them. This matter is not solved.

This has been a torture for last 1.5 months to follow up and try to close everything as a gentleman. But now I need my money back. This should be equal to the sum of the amount paid for PaisaPayID: 33508501295 and 33346196725. Please look into it and process the return asap.
