Buyers beware!!! eBay's grading is not reliable!

I bought a phone from a seller in Ontario but did not receive it. It was sent with Canada Post and the tracking stated that they had delivered it. However, it was not delivered to anyone in my household and was not signed for by anyone according to Canada Posts records. Objects lost in the mail can be compensated for by the Post, but the SENDER has to file a complaint. This seller/sender will not cooperate and file the complaint. You have 12 months to file a complaint, but only 90 days to grade the seller on eBay. So after giving the seller 90 days to help me, he keeps my money and obviously doesn't care if I get the item I paid for, and I cannot grade the unethical seller. He is a Top-rated seller with 97.7% positive feedback. Thus, eBay's procedures does not allow for a just grading and the sly ones will get away with it.
