Buyer rotection for correct but defective item?

eBay buyer protection policy is quite clear about an item that is different from the one put up for sale. The example they give is receiving a copper ornament instead of a gold one.

What I'd like to know is their policy about an item that is the correct type, model, etc., but has a significant defect that is not mentioned in the description. E.g., a camera that does not funtion properly, has a cracked lens, etc. Or a computer hardware that has a major defect.

I'd also like to know if the policy covers second-hand items. Please note that I'm not facing any such problem at present. But the information will be useful to many members for future reference.

Yes the Seller must mention every cracks & defects in there items. If they don't the Buyer can claim refund. However, we need to pay the seller by PaisaPay as it covers the Buyer as well as the Seller against any fraud.

hello sir...iam facing a similar situation now. i had bought an O2 stealth mobile from seller rehaanht. it was an used one and it was looking good when i had bought. but after a week i had issues with sliding. when i checked it up with in the repair store, the reply i recd was shocking. the slider locks seems to have been already broken and a duplicate one was used to fix it up for the time while(slider locks are 2 in number and this guy has used one duplicate to fix the issue). and the battery...ofcourse one more shock for me...battery is almost a drained one. does not even stand for 1 hour talk time which is very bad for an O2. these 2 defects were not mentioned at all by the seller and this constitutes a perfect fraud. but now my hands are tied and i really didnt how to go about this. i bought the O2 before a month. any helps or suggestions please? and the worst thing for me is O2 have pulled back their service network from india and no one dares to even touch an O2 for service. any help or details on service available for O2 please? tks very much Vijay 9841418432
