Damaged item received by buyer due to the negligence of the Courier Company

Hello, everyone. Recently I sold a Sunglass through bidding and it was sold at Rs. 3200. I got paid from the buyer and I shipped the item through Trackon Courier having Docket No:228273771 , after packing it thoroughly. But when the buyer received the item after 3 days he saw a opening from the side which I think was made by someone from the Courier Company. He then opened the package infront of the Delivery Boy and found that the glass was shattered upto the extent that it can be never repaired. He rejected the item and called me that he cannot accept the item and want a refund. It all happened due to the irresponsibility on the Courier Company's Part. I suffered a great loss due to this. I called the courier Company but they keeps giving me nos of different branches which I got fad up of calling. I gave them a Notice for Compensating the loss that they incurred me. I haven't received the packaging yet and I am not sure who is the main culprit. Is it the buyer himself or the Courier Comapany. I haven't accepted the request for his refund because I need to confirm myself first.

So, Please advice me what should I do next.

You will have to make good to the buyer, he has not done the damage, it is courier cos which is at fault and you will have to seek the compensation of the full invoice value from Trackon. 95% of the couriers cos in India are BAD and are completely careless towards the goods that they are carrying and they get away with this only because of our stupid Govt. which allows such culprits to get away with bad service only to fill their own coffers.

Thanks for replying.......Can you explain me the procedure to sue the Courier Company in the Consumer Court. Is it worth suing them or I will shell more money for this Case and get no result from the Law????........

Are there any similar cases happened like this before???

If you want to sue the courier cos the you got have good cash supply, lots of time and lots of patience and a good lawyer.

A much cheaper and easier solution will be to bear the loss of 3200/- and send the buyer a new pair of shades. You will live peacefully and much longer.

This has not happened for the first time and neither this will be last time the courier cos damages a product so what's the point in taking them to court and getting 5000/- compensation after 5 yrs.

Its going to be time consuming and a lot of money has to be put in, but these couriers have to be taught a lesson, please approach the consumer court. While shipping have you given the declaration of sunglasses on the way bill, if you have then you have the complete benefit in court.
