Can a seller deny responsibility for DOA?

Recently I was interested in buying a new hard disk that carries a manufacturer's warranty. I asked the seller if he would take responsibility for any initial defect, including DOA. His unequivocal answer was "No".
Does eBay allow sellers to set this kind of condition? If a buyer buys such a product and it arrives in a broken/defective/damaged/DOA condition, will eBay impose on the seller to do a refund or replacement? Or will the buyer be forced to make a warranty claim to the manufacturer?
