sjewelsdk not responding

I purchased sz 4.5 gemstone ruby emerald pearl bangle bracelet (item number: 250425263592)by paisapay paid Rs.1700.00 on23-5-2009 from sjewelsdk.I have received the item and left good feedback in favor of seller.On close examination my wife noticed that one pearl was missing from the one bangle.It looks odd.I reported to seller but no response.It seems he has sent reject item.Being a power seller i did not expected such item from seller.After getting power seller entitlement the seller don't response and sometimes they sent item not as per specification as mentioned in bidding of a item.I have been cheated by 2-3 time from power sellers.As I was new to ebay i couldn't report to ebay.will ebay take any action against this seller?

Seller informed me that whenever the said size missing pearl available,he will send it.Only god knows when it will be available.Till today i have not received the spare pearl.The seller is a cheater and he intentionally put rejected bangle for bidding.My money will not be favorable to you.
