sold me a non warranty phone as a warranty phone

the seller mentioned in listing the phone comes with one year indian warranty.

I received my item "New 100% Genuine Sony Ericsson BST-33 Mobile Battery".
Again I would like to inform you that the item was under free of courier charges. On the payment page there was a courier charge of Rs20/- for home delivery of the item. But I have to receive the item from the Courier Office. This is for your kind information and necessary action. Please kindly clarify the followings.

1. Packaging is very very poor.
2. The item was not a sealed one.
3. Bill/Purchase memo was not given to me.
