Please let me know who is responsible in this case? Am I, although I
made a telephonic complaint at your customer care regarding this with in
a month of my purchase and it was your executive who denied to process
refund because of so called " Pre-Assumption" case.(the same can be
checked in your record)
Dear friend accepted that eBay is only a platform of sell-purchase but
you should have only genuine sellers instead of these cheaters. How
would a buyer came to know about the credibility of seller, the buyer
really only on eBay and if you are giving "power seller" or "preferred
seller" like category to the seller than how a customer came to know
that the seller is a cheater ? The same happened with me and after
realizing I raised a complaint but the same was denied. You can check
your record.
Dear friend please let me know that what is your policy if a seller is
giving wrong information in their listing and buyer is purchasing as per
the given information. I can provide you the detail that the
manufacturer of this mobile m/s. IMATE corp. Was not operating their
operations at the time of sell. It means on 5-Oct-09. They have winded
their operations on 23 sep-09 from india.it means that the seller was
mis-guiding to the customer at the time of sell.
Dear friend, I am not a single person who is facing these problem from
this seller, there are many who is not getting solution from the seller
or from EBay and those are posting negative comments against eBay on the
Internet. Request you to please check the Internet there are many
negative feedback available on the Internet against EBay and against the
seller.

My self matloob syed. I am having an ebay id matloob12345. I made a
purchase of IMATE JAMA 201 Windows Mob 6.0 56% Off on MRP Rs.15990) on
07-Oct-09. My paisa pay id was 25367104991 and the seller was
Bombaymall. In the listing the seller mentioned that phone will come
with one year manufacturer warranty although he was aware that the
manufacturer of this phone M/S. IMATE has already winded up their
operations from India in 2009 September because of some fraud at their
HQ Dubai. And there was no service centre available in India for this
phone. But seller did it intentionally. I made a call to the customer
care on 13-Oct-09 regarding this matter. I spoke to the executive and
told him all the detail.then he suggest me to contact seller directly
through the link "contact the seller" at seller listing. Then I sent a
email to the seller through the same link but I didn't get any response
and the same can be checked from record. At last I made a call to the
seller and told that the manufacturer of this phone is not available in
India so how would I get the warranty in case of any fault also asked
him that why he didn't respond against my email.he told me that he has
high workload so was unable to reply. Then he told me that in case of
any problem with the phone during the warranty he will provide me the
solution. Then again I made a call to the ebay customer care and
explained full detail of the interaction. Then the executive asked me
about my concern so I told him that I am not interested to keep this
product. He asked me the reason and I replied I would not get
manufacturer warranty because of non-availability of manufacturer. He
told me that seller is providing me the assurance of repairing in case
of any problem and also told me that I am pre-assuming the things that
the problem will occur and in this case of pre-assuming background they
can not process my refund request. He also suggest me that I have to
accept the promise of seller. And in case of any future problem I can
contact ebay customer care also. So at that time I don't have any
option left rather then to accept the solution provided by the ebay
customer care executive and by the seller.
Dear friend after three month of usage many problem had been started
in the month of feb-10.so at that time I contacted to the seller
BOMBAYMALL and explained him my problem. Then he replied me that nothing
can be done in this regard because seller has winded up their operations
from India.so I reminded him his commitment. He told me that he can not
provide me the service. Then I again complaint regarding this at your
customer care. I spoke to Mr. SOHAIL and Mr. PRANAY and told him all the
detail from the first day.then Mr sohail suggest me to visit at seller
site personally. So I did the same thing .I went to seller office
situated at MASJID BANDER-MUMBAI on 07-April-10. I met to Mr. Abdul. He
told me to left the phone with him and assured me that he will repair
the phone and told me that I have to pay the cost of repairing and I
accepted the same.but later seller told me that the phone can not be
repaired also told me that the phone was tampered which was not really
happened. So at time I felt that seller is trying to escape himself from
the commitment.
Now dear friend the so called PRE-ASSUMPTION by your executive earlier
became realization. Who would be responsible for this ?Now suggest me
what should I do ? I require full working mobile phone or my refund as
earliest possible.

Dear friends it seems that ebay is meant to favor sellers only and
because of this you have given power seller listing to this seller
bombaymall although the seller is cheating customers with the fake
commitments.

Please provide me the solution as earliest possible.
