ebay or gambling

I purchased a blackberry storm. The sellers says its in new and unused. But the phone is used for more than 2 years and it is repaired several times. The phone become complaint in a few months. So think before u buy. Do ebay has any responsibility in this?

eBay has a Resolution Center where you can complain and get refund.
