Dear Mr. Avinish Bajaj !!
I am fed up with eBay. I had raised a dispute a long time back and sent all the sufficient documents to support my claim! But mysteriously eBay decided to close the dispute!! Reason; dispute open more than 90 days!! But the action was on eBay!! Why should I pay for eBay's mistakes? If eBay can't solve the dispute how can it close the dispute? With out any explanation of what went wrong!
Here is the sequence of events,
1. I bought the item
LATEST CORDED & CORDLESS TELEPHONE/PHONE WITH CID (5773884304) and paid online through Paisa Pay (Paisa Pay ID 57338562). Payment was sent on 21-May-2005.
2. Never got the item, I raised a dispute on 4th June to eBay.
3. I re escalated the claim to eBay on 16th June as well as 27th June but to no response from eBay!
4. Some time in mid July (one and a half months after raising the dispute) I get a mail from eBay saying that in need to fax the relevant payment documents to US(??) with in 14 days else the dispute will be closed ??
Also I needed to supply a pay pal account (which I never had) and they will pay the money into the pay pal account in either USD/Euro/Yen (I need to remind you that India uses rupee as its currency)
I was a bit surprised as the transaction happened in India the seller and the buyer was in India but the dispute is to be settled in US, I need to spend a great amount of money to fax the required proof to US and why would I need to supply a pay pal account (I am not sure weather a pay pal account is allowed by RBI and is legal in India) I raised my concerns to eBay but they never replied and never supplied the Indian fax number, but told me to fax it to US. I faxed the documents immediately, but I got no reply for over a week, later after repeated enquiry, I got a mail saying that they did not receive the fax. They asked me to resend the fax which I did so immediately after spending some more money! but eBay did not respond for a while , later they send me a mail saying that the dispute will be closed as it is more than 90 days even when the action was on eBay’s side. ??
I think eBay is not interested in resolving any disputes but is hand in glove with fraudulent sellers to make money out of unsuspecting and genuine buyers. They want to put the buyers through a lot of hardships by saying that all disputes will be resolved in USA. I would like to ask eBay if they have specified the same anywhere in their website and if the same is legal in India. Does it confirm to Indian laws?
eBay should answer the above questions as it is relevant to all users...
