eBay Supporting a Fradulent Seller - Refuses Claim

Hi All,

We regularly orders / purchase from eBay for Gifts to give to our employees in the Team.
We only order itmes categorized as new however the seller for the Black berry phone we ordered had listed a used phone as new.
The Black Berry phone was handed as a gift to one of our employees & it was found to be used.
We raised a claim immediately the same day which was within the stipulated time for claims of 20 days.

Item Title - BLACKBERRY CURVE 8520 MOBILE

If you check your records the item was listed as new though it was used.
We happened to talk to the seller too & he says it was hardly used for 10 days so I don’t see on what logic it is new.
We have spoken to your claim agents multiple times in the contact center however there is not much done.
The claim has been closed & the update we get is that your team couldn’t get in touch with the seller & later that the seller was not ready to accept.
So we don’t understand what is eBay Guarantee when you very well know that the seller is at fault.
Can you get this resolved immediately?
