Written CD's advertised as original

I had bought a game CD from a e-bay seller and found to my dismay that it was a written CD. The game is not copiable and wouldn't run if written. I would like to know if written CD's are allowed to be sold. ALso what recourse do I have with the seller for duping me.I hope the ebay team makes note of such instances and inform sellers about posting only Authentic CD's for sale.
