Seller's negligence towards buyer

I received the product on 7th Dec 2012 in the evening and immediately after testing I found the product to be faulty and sent a mail to the seller, along with pictures of the product being faulty.
I did not receive any mail or call from the seller, hence I called him and explained the issue. He assured to check and get back to me regarding a replacement.
He never called so after few days I followed up with him. He said it will take some time and if the product is not available then he will send a refund.
that refund never came and everytime he gave an excuse.
Today finally he said that they won't be able to give a refund so if I want I can buy another product of the same value. I denied that and he hung up the phone.

I checked on your website and found that this kind of issues has to be reported within 45 days of transaction, which I was not aware of.
I would really like you guys to take an action against such sellers who do not keep up their word. I would request you to kindly help me to get a refund.
