1. The undersigned purchased item No. 4609024515 from the above mentioned seller on 02 Feb and paid for the same through Paisa Pay on 02 Feb. The e-receipt for the same was also received on 02 Feb. However the item has not been delivered till the 14 Feb 06. As a reply to a dispute query the seller claims that he is unable to access his account with ebay due to "suspension" and has asked for the address of the undersigned in the form of a response in the dispute proceedings. The same has been done so on 14 Feb.

2. Pertinently why is ebay still listing his items if he has been suspended? E bay may consider it necessary to take due cognisance of this message and remove the above mentioned seller's items from the listings.

3. Further, in case of non receipt of the item within the next 5 working days the undersigned intends to escalate this to a claim and initiate legal proceedings against Ebay and the seller incase of non remittaqnce of the claimed amount.

4. This note is communicated in consultation with a lawyer for a consumer forum.

5. Awaiting a response.

My sincere apologies for the unpleasant experience you had at eBay. Most transactions on eBay do happen smoothly, however if a buyer has a bad experience, eBay offers Buyer Protection to its buyers.

If a buyer does not get his product, or the product is significantly not as described, the best option for the buyer is to open a Item Not received dispute against the seller. (My eBay>>>Dispute Console)

If the seller does not respond, or the communication fails at any point of time, the buyer needs to close the dispute and escalate the claim for Buyer Protection claim.

Nice to see such a senior & respected executive like you on this board but its a pity that the cause is not at all pleasant.

I have a few comments about your problem.

I have received items from suspended members a couple of times. Hope you will also receive your product because the seller has very few non-positive feedbacks.

eBay suspends members for a wide range of reasons. Hope that for your seller the suspension is not for fraudulent activity. In that case you will have a fair chances of receiving your product soon.

As per eBay rules you are most likely to receive a refund of only Rs.199 for Item not recd dispute. In that case you will loose 100+ for no fault of yours. I earnestly hope that your experience for this transaction won't be that bitter and you will do more transactions on eBay in near future.

Every body is well aware that for a mere 299.00 , no body would be using any consumer forum ... i just pray that such esteemed members get an immediate and complete refund which would not leave any non pleasant memories for a new buyer .... These things happening as a regular feature are not good T all for the site
