Does this qualify as "Product significantly not as described" ?

I have not actually been in this situation, but the possibility is real for any regular buyer. Suppose a seller describes a used product as being in excellent condition, but the product received, while not totally unusable, has a significant functional defect and/or blemish. Suppose further that the seller had imposed a "no return/refund" condition in his description. Does this qualify for eBay's buyer protection ?
