Subject: Reference to claim 51609, I request for a full refund
THIS IS MY FINAL EMAIL TO EBAY PLEASE

eBay India managment,
Please ref to claim 51609 for item 150615457296 purchased from dvd store delhi seller mr.kapoor.
This is inform you that I had purchased HDD from above mentioned seller. Right from the moment I have received the HDD it is not working. as per the seller's and claim adjuster's suggestion I had communicated with the technical engineer at my own cost. However the technical engineer clearly informed me that HHD is not working.
I had discussed this issue with the seller on conference, where seller has agreed to refund my amount of Rs. 3700/- out of total amount Rs. 4460/-. however claim adjuster has conveyed me the seller's message that "seller is ready to refund tha amount of Rs. 3800/-" Deducting his ebay fees and shipping charges. when the item from the seller is faulty why should I bear the loss. Till today as of this moment the item price mentioned in listing is same Rs. 4460/-
Seller has also suggested me on call with claim adjuster to make alterations to the HDD from techinal engineer and try fixing the issue. seller has also suggested me to resell this item on ebay site. (It is mentioned in ebay policies that any alteration in the product claim is noneligible. Reselling item claim is non eligible) seller is asking me to do that on recorded call, "THAT IS VIOLATION OF EBAY POLICY"please note .
Seller and claim adjuster are asking me to get in touch with western digital service center to exchange or repair the HDD. I had contacted the western digital their reply was get in touch with the person from you had purchased and it may take 15 to 20 working days. There is no question of getting touch with the Western digital, its the seller's and claim adjuster's resposibility to Exchange the item (As per the seller's policy under the listings) as per my requirments i should be REFUNDED MY money back.
As per the ebay policy if item is not as expected there is 100% money back offer, I had paid to ebay and ebay has tie ups with the seller so why should I visit western digital.
As per the seller's policy under the listings it is clealry mentioned๏ฟฝ
1) "7 days Exchange offer"
2) "Seller assumes all resposibilities of listings"
My Date of transaction 11-june-2011 and I have received the HDD on 14-june-2011 by Bluedart courier.I had raised this dispute on 17-june-2011 (i:e within 7 days as per the seller's policy of exchange under the listings;)
I want this dispute to resolved from seller's and claim adjuster's end at the earliest; Please arrange pick up facilty to send item back to seller it is ebay's resposibility to get in touch with the seller and provide me a full REFUND.
I hereby make my intent clear that in case of such harrasment by such sellers i shall be forced to go to consumer forums/ courts for the gross injustice being done to me by the seller.this shall not be in good spirit of being a ebayer as it might bring a bad name to ebay as well.knindly note that ebay is such a reputed organisation and such sellers cause a stake of the same.this is not at all a threat but a humble request for justice..I HAVE ,I AM AND ALWAYS WILL BE A RESPONSIBLE EBAYER AND ASSURE YOU OF THE SAME. KINDLY HELP ME GET JUSTICE AND MY RIGHTS AS A EBAY CUSTOMER.
