Dear all, I am describing my case in short here.

i purchased PANASONIC VIERA THP42C10D 42" PLASMA TV !WARRANTY! NEW (#270493568475)in the deals of the weekfrom solardigicam -Delhi on 09 Dec 2009 and paid an amount of Rupees 37,290/- almost instantaneously through PaisaPay from my ICICI account through net banking on e-bay.i waited for the item since it was a good deal sensing the item not being shipped for some time i contacted the seller. there were long discussions with the seller who asked me to arrange way bills Form 50(meant for dealers who are importers or wholellers)for which i ran around,but to no avail tax autorities when asked me about TAN/TIN numbres which i was unaware still tried my best . i informed the seller about my inability to arrange 1. i waited eagerly untill the last day of his timeline of shipping there was no news of shipping the item from his side. on last day i was informed that this item has been shipped. i continously tracked the item it on courier site showed that was delivered at Allahabad approximately 700 kms away from my location when i contacted the reciver he was a diffrent man with diffrent item . worried i contacted the seller who told me the same old story of Form 50 without which the state of W.B shall not let my item being shipped in the state i again did the running around with same result itold the seller the same. Finally, frustrated, i initiated the refund but the seller put this refund on hold he informed me that he has reshipped my item through new courier company when i asked him what about the details he had given me about wrong shipment he did not answered my question and told me that in all this trouble 1 of his tv got broken but he is sending me my item with all clearences which should reach me by 25 Dec 2009. i waited for the item it finally arrived on 28 Dec 2009 i asked the courier company to get open check being a fragile item and the no of transshipment it took before reaching me ,but this opportunity was denied to me by the courier company since courier was to be recieved by me first as it aws a non insured (as is where is basis Courier booking)Being non insured and free shipping to me by the seller i had to accepted the item since even there were no signs of physical dammage from outside and i was given opportunity only to inspect visually . finding no dammages from outside either to the caton or to the wooden jali i accepted the item at courier office ,But still i opened this item at the courier company's office. when i opened the item i found the display screen completely shattered from inside but the front panel was intact which surprised me and that carton packing too was intact, there was no other coushioning other than that of the and the flimsy Wooden jaliof three grids of AAM wood from outside the carton.
thereafter my worst nightmare started i frantically called up the dealer and e bay the dealer asked me to pay additional Rs 10000/- for reshipping the item. i then called e bay who had put my money on hold to provide replacement or my money back . therefter i kept on calling e bay without any satisfactory reply from e bay executives with diffrent suggestions ranging from reshipping the item to the seller to talking and resolving the matter with the buyer finally i reported the matter in ebay resolution center. the next day to my horrors i found through that my money on hold request was turned down and the money was released to the seller. seeing all my effort going in vain again i called up the customer service executive who told me to hold the item till the painstaking finallization of my complaint resolution. which might take upto40 days, so here i am stuck with the junk costing me approximately 40,000/-of my hard earned savings and still waiting for a solution .
since this was a non insured item the courier company absolves itself from the problem and offers the little money approximately Rs 150/-(one hundred fifty only) as damages for acceptance of the shipment -that too at the booking agency at Delhi to the sender in this case again the seller.
Please help and advise me how to get my hard earned money back.
E- Bay please pay attention and please process my case of refund as fast as possible.

Dear all ,you may shoot direct questions to me .i see this game is now getting murkier since i was the 1 who was at receiving end for a month + i can tell what i had gone through.
i got the refund from ebay through e bay buyers protection programme.
Mr harsh contacted me after i raised this issue in this forum.
when i recieved tv in broken condition i asked the contact man of Mr harsh about the condition of TV in which it was recieved i then asked for replacement and asked about the insurance of this itemwhich he told me it wasnt insured. Mr Sunil Nagpal asked for Rs 10000/- when i protested he setteled for 6000/- to ship another TV.

I was taken aback . i asked for refund . His answer was well see...........Now imagine the plight of a buyer who has invested his hard earned money for a junk.
Mr Harsh be honest you only contacted me when i raised the dispute and started this thread on this forum before that we had only 1 communication when i asked u about the shipping date and u had directed me to Sunil for all future communications.

the serial no of my tv was YT9KA01347.

continuing my clarifications for this item below.....
once i contacted Mr Sunil Nagpal who was giving me replies like "If you send us the item back Then well see what we can do".i was still in favor of getting a new replacement but when i heard these replies from him i raised the dispute.
Now imagine a person who has already paid an amount including shipping for a deal and again he has to dish out another 6to7k for a junk without assurance of the outcome of his refund will always raise hue and cry. Mr harsh i will honestly say the dealings of Mr Sunil will scare away your potential buyers.
secondly the airway bill of first flight which wasnt destined to me really raised my faith in your dealings. which you later clarified to me that it was to cover up the time limitations, that again was fault on your part you could have asked for extension which e bay generally grants if buyer and seller agree to.
this whole issue was further complicated by a few e bay cust care execs; when i agreed to physically deliver this item back to Solardigicam after speaking with mr harsh and was about to deliver this broken tv at his shop in delhi some of the execs of e bay advised me to refrainfrom physical delivery and follow their instructions if i want my money protected under buyers protection program.
Now the question of physical delivery arises? why i was doing so.
the answer is -first of all the cost involved in in sending the Damaged TV was very high. secondly who was to foot the bill. thirdly no courier company was ready to accept the broken item for delivery.so i had to resort the physical delivery thru 1 of my reps although he was paid up for travelling expenses by Solardigicam but it caused lots of trouble.
Now the question why i didn't get the open delivery?
The DTDC courtier had refused the open delivery since it wasn't an insured item and the delivery was on as is where is basis if any 1 wants i can forward the scanned copy of POD still i opened this item on the courier office who as per their terms and condition asked me to file a complaint and told me that since this wasn't an insured item i will not get any amount more than Rs 150-250 since the fragile warning wasn't mentioned in the outer case.Even i filed the complaint and got this paltry compensation it will be given at the booking end and to the person who booked this item.
Now lastly Mr harsh you mentioned to me that you are going to be compensated for this Broken piece by the Company. So folks don't worry the sellers aren't at loss either.any 1 wants to know more please feel free to mail me at faransqi@gmail.com i will happily assist you since this harrowing expirence has made me much wiser and much cautious about online buying especially on ebay.

i agree with shine_of_diamonds statements and u also did the same with me
1.We should always check the item before accepting the item.Ok but how you didn't asked the courier company to do open delivery.They always say we received it in packed condition & delivering you in the same.Its impossible to check in front of courier delivery guys unless you ask them them to do open delivery.

2.You never said you wont not refund the amount.Ok So why you claimed appealed against my refund knowingly I returned It.You failed to supply POD to eBay otherwise I might have lost my money, You also asked faransqi_09 for Rs.10000 more to ship new item.

Have you got your money back? Actually, I also need advice from you, since I have bought a camera from M/s Solardigitalcam of someone Mr. Harsh Nagpal. I got his number from the listing so I called him before purchase and he told me to buy via COD and he will give me free camera case.

I have paid the money to delivery boy, and it was shocking to see the item. It gave me immediate feeling of refurbished/second item. I called and told him about my concerns, initially he spoke nicely but when I demanded the refund then he started talking filthy and told that why I have bought from him and if I have so many issues and concern than I should have bought from Panasonic Retail Outlet. Whereas, in the product listing he has clearly written 100% money back guarantee for 14 days.

I am very much shocked about his words now. He has written on eBay that I have not even purchased the camera.

I really do not know what to do? I would be really grateful if you can help or guide me how to deal in such situations.

Use the Ebay Guarantee Program (see link on top of this page)and you will get replacement or refund of your payment, whatever you prefer.

Let me tell you here that all big camera sellers here on ebay have the same high handed and bad behavior, I have had bad experience with most of them and that too I am a professional photographer for more than 20 years now.
