Seller has not shipped item in 7 days, given a false shipment number

Hi,
can anyone suggest me, how to get refund in this situation.
i had ordered a apple ipod touch on 11/05/2010 and last date of shipment was 18/05/2010. Seller cleverly given wrong shipment details on ebay on 18/05/2010.
when a tracked shipment number on bluedart website & even talked to their support executive.it was found that the number is wrong or seller has not delivered consignmnet to bluedart.
Even on contacting seller for cancelling of order, he still said i have shipped the item, and was very rude in talking.
Actually, i have lost faith in seller.
Now i want to ask, as stated by ebay that if item is not shipped on or before 18/05/2010. Am i eligible for refund.
if yes how to go about it.

My problem has been resolved.
However this may be practice used by seller, to avoid auto-cancellation by paisapay.
