I bought a product from a seller who on his product page says that he is an international reseller. and on his product page in the product features he offers, 90 days money back guarantee.
on the same product page ebay says

I received this product in time but when I used it I found it totally uneffective. not even one percent functional. I mailed to the seller three or four tiimes. He did not respond even once.
I then claimed a file with ebay. they closed the claim saying the item does not fall in this category.
NOW MY QUESTION IS ,

and they shold have mentioned here about the product not being in the guarantee.
