Product out of stock after customer place order customers struck-refund

this process need a fix on no refund if product not in stock even after info from seller by e-mail
as a cusomer after placing order seller informed me saying item out of stock now i need to wait till 7 day turnaround for a fix of my refund knowing my product will not get delivered on 2nd day of placing order for whic after consulting with ebay support informing customer they need seller confirmation for refund not customer ...so customer is struck between seller and ebay losing many deals within ebay ..example weend 10 % off ...?
