Fraud by Seller and He is Not Refunding the Money after Promising to do so

Dear Buyers,

I have had the worst experience on ebay and would love to get your advice. Seller prince37_in1 listed an item as an "original M.F.Husain painting". He told all the buyers that he had an "original certificate of authenticity from the painter" and offered a full refund if the buyer was not satisfied with the painting. I spoke with him numerous times on the phone and he told me that it was an original, that he was a shiv bhakt and would not lie, that he had the certificate of authenticity etc. I bought the painting for Rs 199,000 on 14th August. When the painting arrived on August 21st, I was shocked to see that it was a reproduction calendar print and there was no certificate of authenticity! I immediately sent it back, opened a dispute claim and asked Seller for my refund which he promised to give promptly. Seller sent Rs 49,500 and asked for 10 days in which to return the remaining money. It has been a few weeks since and Seller keeps delaying making excuses that he has spent the money and needs more time to get the money. What should I do? Rs 1.5 lakhs that he owes me is a HUGE amount of money for me and I need to repay the bank debt I took to buy this painting. I have given him till 20th October and after that plan to seek Buyer Protection Claim and also have ebay investigate this fraudulent seller as he clearly and intentionally deceived me. Also he has now relisted similiar paintings saying now that they are "reproduction prints". This has been a very stressful experience and I don't think I can trust ebay anymore as a platform. I would appreciate hearing from buyers who have had similiar experiences to see how they resolved their disputes and if they were able to get full refunds. Thanks in advance for your comments!

Its not his fault its yours. If something appears too good to be true it generally is. Always take that as a rule of thumb. And how could you not use paisapay in such a sensitive transaction of such a huge amount? Where is the seller based, and where are you based?

Dear Buyers,

I used Paisapay to pay for this transaction. Please let me know if any of you have escalated a dispute to Buyer Protection Claim and then got also got ebay to press fraud violation charges against a fraudulent Seller.

Thanks for your comments!

I Purchased a car using eBay and it turned out that this 2007 Car should not be on the road and has a 3 page list of faults so I started to look at the seller of this car and soon discovered he was in fact a car dealer and had been kicked off eBay several times after a couple of the members complained about him.

Since I have consumer rights I contacted eBay to ask for contact details and what I got back was half an address and a telephone number registered to an hospital. I asked eBay for more information so I could take civil actions but they did not reply. Other people contacted me and told me that this particular trader has had several accounts closed down already and they to would like to contact him.

It seems to me that eBay are only concerned with getting paid and you can bet payment for the advert of the car I brought got paid no trouble.

Since eBay wonโ€™t protect buyers I decided to write a program that list all the cars the seller has sold in the past along with technical details for each car and in some case it provides an average selling price. See http://ebaymotors.freeblogit.com/

Later I will be publishing a list of sellers on the internet who are not registers as a business and are selling several cars a month with links to cars they have sold in the past in an effort to get eBay to protect buyers and ensure they donโ€™t hide behind the data protection act when asked to provide details and to pass on more information so that fraudsters can be tracked down.

eBay are quite able to stop this practice and all they need to do is write a bit of SQL like
Select Count(*) from Sales Where Count>5 and ItemCategory =Car AND AccountType=โ€™Privateโ€™
