Gray market is the alternative market in which the item is genuine but the selling channel isn't legal.
Internationally available branded items have a slight variance in the price in different markets. For example, a model 'A' of canon camera is available for different prices in different markets. In Singapore, it would be cheapest followed by Dubai whereas the same product will be slightly expensive in India and more expensive in UK and extremely expensive in Sweden and Finland. The reason for the price variance is the tax structure of different countries. The people who take advantage of this situation are gray market traders or in simple words - smugglers.

The dealer/service center will have the record of all the items that are sold through genuine channel. All such items will have a code. The gray market item will also have a code but it won't be active.
Why the items are sold in gray market is a subject of research and economics and this isn't the right platform to discuss such things.
The buyer should purchase an item from the genuine dealer. As soon as they receive the item, they should login into the company's website and enter the item code. If this facility is not available then the buyer should contact the service center. Once they confirm it to be covered under a warranty as stated by the seller then only should they retain such item. Else, the buyer should file a Significantly Not As Described case against the seller.

When a Seller sells a product under a Dealer / Sellers warranty expressing stating the terms of the warranty on the product lising page, what is he doing wrong?
How and why a SNAD (significatly Not as described) case be opened against him?
He never claims that his products are with Manufacturer's Warranty.
Just an aside, many a times products can be sold without Manufacturer's warranty but these may be perfectly legal sales.
Many products are imported by individual and companies which have not relation with the manufacturer of the goods. These are imported legally by paying all the import duties, etc. All vat and other local taxes are also paid on these goods. These sales is entirely legal but would not normally be covered by Manufacturer's warranty. This is called alternate channel which may be different from grey.

Lets take Laptop for an example.
Lets say, the seller lists a laptop as a Brand New.
Now, if the seller doesn't provide the manufacturer's warranty but provides his own (dealer's warranty) then any prudent buyer would understand that the Laptop is from gray market.
If the item is new and still the seller isn't offering the manufacturer's warranty, then there is a 100% chance that the item is either out of warranty or a gray market item.
I hope you would agree to this.

FYI....
The alternate channel is a better word to describe gray market items. If the item doesn't come with the manufacturer's warranty then it is gray whether one person agrees or not.

A dealer warranty without a manufacturer's warranty is a gray market item. Dealers provide dealer warranty because they know that they earn much more from selling the gray market items at the same cost of normal items. The difference between the gray market item and the official channel is at least 20% (Please note that there is no VAT, CST etc in this channel).
I know this as I have spent few years of my life working for electronic retailers in India and abroad.
