Ebay isn't helping at all

I have bought a phone from Ebay, Seller claimed in the listing that the product was new/sealed pack, I reported to ebay that phone wasn't sealed back, had no original battery and a harware button wasn't working, no help from Ebay, the customer care executive said that they can not do anything about it. I did everything right from A to Z right, customer care didn't even try to resolve any issue. They just didn't hear me at all or resolved any of my query and hung up on me, It took me an hour to call them and they just hung up on me. I have been trying to stay in touch with the seller he asks me to send him the product back and says ebay would refund the money. I am just helpless don't know what would be right for me to do, ebay doesn't answer to my query and the seller is asking me to send back the money, I don't know if I should trust the seller.
