Item not as described

I have placed an order through ebay and payment made to seller through personal cheque in their account but when i got the item which was different from the shown item on ebay and after complaints seller does not accept his mistake and updated/changed the figure according to sent item. Is it not a fraud with the byers ?
Ebay works like a dictator with the Bayer just by giving the deadlines.

NEW HTC HD7 Unlocked Windows 7.5 , Wi-Fi , 3G, 16GB. #281052779447 is buy on 09/02/2013 & received on 14/02/2013 but not in proper conduction
HTC HD7 is not working properly, after working 20 mins set will "OFF & ON" automatically for many times....
USB port is not connected with PC or other devices...
This hand set becomes quickly..... auto switched OFF & ON start continued...NOw what should i do with this mobile say...
