Ebay should control VAT charges on lisitngs.

Dear Ebay team,

As we all know that we have option of VAT charge addition to listing prices.
But some sellers are taking undue advantages of that.

As per our legal records the max VAT on computers & electronic product is 4% VAT & 3 % CST in all states.still some sellers are charging 10 to 15% on listing ,

They drop down there listing prices & add 10 to 15% tax on that , its will create some wrong impression on buyers mind.

Ebay is also loosing there part due to it .we request ebay team to look after it , we need some good firm polices on that so no one can suffer.

We hope for reply from our good seller & community members regarding this.

Regards.

mahavir_in1,

The current rate of taxation for CST is 3% against "C" Form.

For sales to unregistered dealers, it is 3% or rate of VAT whichever is higher.

So if the rate of VAT is 4%, you pay 4% CST and if the rate of VAT is 12.5%, than you pay 12.5% CST when goods are sold without "C" Form.

You need to pay either VAT or CST and not both.

You are charging VAT / CST at the rate of 7% for Apple Ipods where the rate of taxation is 12.5%

You abject lack of knowledge of tax rates simply implies you have not paid any CST in the FY 2007-2008.

So who are you kidding?

"we import cameras form Singapore & Indonesia"

hmmmmmmm, the whole community would love to see one single
"Bill of Entry for Home Consumption" for digital cameras which you have sold on ebay which has a duty paid price less than your ebay selling price.

Of course you may by importing without paying any import duties, which is called "smuggling" and not "importing"

Hello,

99% of the Sellers use ebay India to sell New products and only 1% may be using it for selling Old things, lying around.

There are many Sellers who specialises in selling 2nd hand Mobile sets ... and it's their business.

Selling goods, even worth Rs.1 outside the State, one needs to have a Sales Tax Number. The exemption upto a certain amount is only there when you are selling within your own State.

ebay says that they provide a platform for these transactions and it's the duty of the Seller to abide by the Government Laws.

But if the system provided by ebay is against the Sales Tax laws then ebay too, has a liability.

For all Inter-state transactions charging CST should be compulsory as per the Item Category. It must be compulsory for all Sellers to provide the Sales Tax / TIN Number if they are selling goods outside their State.

This will not only bring ...

1. Clarity in the system,
2. Weed out grey market goods,
3. Create level playing field for Sellers

.... but also help the Sales Tax department to collect proper revenue.

Young Enterpreneors trying to make a living out of ebay may otherwise one day find themselves in a tricky situation .... just because of un-awareness of Sales Tax laws. .

Re: Ebay should control VAT charges on lisitngs.

Hi, if your annual turnover is below 5 lakh, you can sell your goods without vat number to your state not other states. But keep the records of your sales is absolutely necessary necessary, all the goods you shipped through courier/logistic company pass through check post so any check post officer can call you for any clarification about your parcel!! It is legal to sell goods to your state without vat number if your annual turnover is below 5 lakhs, but keep the records of sell!!!
