CST/VAT registration for Selling live plants through eBay

We are sellers of live plants through eBay since Sept. 2014.  As CST/VAT registration has become mandatory, kindly advise -

 

1)  Whether registation of CST & VAT is required for sale of live plants to buyers at different states within India.

 

2)  Whether eBay will collect tax from sellers (for sale made through eBay) and make payment to governement.

 

3)  Live plants being an agricultural product, whether any relaxation is given for Registration of CST/VAT by govt.

 

4)  Whom to be contacted for the Registration of CST/VAT for  home-based sale made by post from Kerala State.

 

5)  What fee and other formalities are required to be completed in this context with the Govt.

 

Kiindly let us have your expert opinion on above points, keeping in view the exemptions given by the Government on agriculture and agricultural products.

Here is the deal.

1. It doesn't matter if your product comes under exempted category, GST is necessary for online selling. I sell books that are also exempted but still they demand me to register for GST.

2. GST is something that you will need to collect from buyer if it's applicable and submit it to govt. There is no need to collect if your item is exempted. You will have to submit 3 forms online every month to GST portal regardless of fact that you are selling exempted product or taxable.

3. Like I mentioned in point 1. Even if your products are exempted, GST registration is mandatory for online selling.

4. Contact a chartered accountant. He will explain the entire procedure to register for GST. You can also register online by yourself.

5. There is no fee as far as govt is concerned. However if you choose to take services of CA, he will charge you. As for documents, it depends on what type of business are you running. Is it individual/self proprietary, company etc
